A Kumasi High Court has granted a Substituted Contempt Service notice to Freko FD Company limited to be served on the Mayor of Kumasi Kojo Bonsu.
The substitute service was necessitated due to what the Plaintiff describes as a deliberate attempt by Mr. Kojo Bonsu to dodge notification of the Committal for Contempt charge against him.
The notice signed by the Registrar Isaac Essibu, copy which has been intercepted by this paper reads, among others, “…It is hereby ordered Notice of Motion for an Order of Comittal for Contempt and the supporting affidative be served by Substituted Service by posting copies thereof and copies of this Order at the following places for a period of 8 days.
i. Notice Board, High Court, Commercial Division, Kumasi
ii. The occupational Address of Respondent (Metropolitan Assembly) Kumasi
iii. By publication in any daily newspaper.
Lawyers for Freko FD filed an application for Contempt against the Mayor of Kumasi Kojo Bonsu for refusing to heed to an order of Interlocutory Injunction restraining him or his assigns from impeding the work of Freko FD as managers of the Kejetia terminal in Kumasi.
The court presided over by Justice Emmanuel Amo Yartey ordered the Mayor, his agents, officers, servants, workers and assigns not to interfere with Freko's possession, operation, and enjoyment of the terminal.
The court also ordered that the defendant (KMA Mayor) to vacate the premises so as to maintain the status before they took over the premises.
However Counsel for Freko, Richard Appiah- Nkyi Esq. prayed the court to commit the Respondent herein for Contempt of court for bringing the administration of Justice into irreparable disrepute by willfully refusing to vacate the said area.
Mr. Appiah- Nkyi also prayed the court to order the Respondent to pay for the cost of the instant application as well as any other costs attendant to and or consequence posture and behavior, coupled with the immediate vacation of the Defendant from the terminal.
Today newspaper has been following keenly what has become known as the 'Kejetia Invasion' which many well meaning Ghanaians have expressed varied views about.
