Counsel Of The Council Of State Binding?

What Is the Council of State? The Council of State is enjoined by Ghana’s 1992 Constitution (Reference Chapter 9, Article 89) to “counsel the President in the performance of his functions”. The Council is required to “consider and advise the President or any other authority in respect of any appointment which is required by the constitution or any other law to be made in accordance with the advice of, or in consultation with the Council…” The council, upon request or on its own initiative is to “consider and make recommendations on any matter being considered or dealt with by the President, a Minister of State, or any other authority established by the Constitution.

The role of the Council of State came into the full glare of the public when the montie trio were thrown into jail for their illicit comments against the Chief Justice and other Judges.

After this unfortunate comments were made, the famous montie 3 were hauled to court and charged with contempt.

Petitions from The Then NDC Ministers of state and party members were signed and presented to the then president, His Excellency Dramani Mahama who after receiving the petition and CONSULTING with the COUNCIL of STATE freed Them.

Fast forward to 2017 with New Government where the President His Excellency Nana Addo Dankwah Akuffo-Addo is being required by the constitution (chapter nine Article 89) to have a Council of State to COUNSEL him in the PERFORMANCE of His Functions.

Now the Question Is, Is the counsel of the Council of State BINDING?

Is the President bound to the Counsel of His Counsel Members even when this said counsel s strongly opposed by the majority of Ghanaians ?

Is the role of the counsil of State necessary considering meeting at least 4times in a year unless requested by the President, Parliament or at least 5members of the council?

Well I think the Role of the COUNCIL OF STATE IS VERY IMPORTANT to the Country's Democracy as it serves as a check on the appointments and decisions of Government .

As to if their Counsel is BINDING It should be BINDING if the CONCIL CONSIST OF STAKEHOLDERS AND CIVIL SERVANTS..AS THESE CATEGORY OF PEOPLE Have the Nation's Interest at Heart and not by members appointed by The President and thus are bound to support His decisions regardless as in the case of The Montie 3
