Labour Commission to sell properties of Asare Original Pay All

The NLC has filed an application in an Accra Fast Track High Court to attack the properties of Stephen Asare Enterprise, a lotto company, also known as Asare Original Pay All, following its failure to pay a judgment debt of GH¢ 97,350.00 and costs in favour of its 89 former employees.

The properties of Stephen Asare Enterprise, so far seized by the Sheriff, are a KIA Sportage four wheel vehicle, a two-storeyed house at Tesano and a piece of land at Nungua, both in Accra. They are to be valued and auctioned by a court order to meet the payment of the judgment debt.

The action of the NLC followed the failure of Stephen Asare Enterprise to comply with a decision of the Commission arrived at through arbitration to pay severance package to its workers who were declared redundant.

This prompted the Commission to apply to the High Court for the enforcement of its decision.

The Commission obtained judgment and the Company (the judgment-debtor) was ordered to pay the debt in installments beginning from the end of June 2008.

Upon the failure of the company to comply with the court order, the Commission applied to the High Court for a sheriff to attack the properties for valuation and eventual sale to pay the judgment-debt.

Last year, 89 workers petitioned the NLC for non-payment of 12 months' arrears of salaries.

The workers were further declared redundant. After the inability of the company to pay the arrears of salaries, the Commission obtained a court order to compel it to pay the arrears which it did by installments.

Thereafter, the issue of the quantum of the severance package went to arbitration and a binding award was pronounced.

The company"s failure to pay the arbitration award led the Commission to institute legal action against Stephen Asare Enterprise to seek to auction the company's properties to pay the redundancy package.
