Chief Justice Must Act With Assertiveness, Prudence And Fearlessness In Dealing With Corruption Allegations In The Judiciary

We the National Advocates Against Corruption and Injustice (NAACAI) wishes to implore on the Chief Justice of the Republic of Ghana to act with assertiveness, fearlessness and prudence in taking the necessary legal and constitutional steps to deal with all the members and matters relating to the allegations of bribery and corruption made against some members of the Bar as well as the bench.

We have been informed that, some laws of the country as well as the articles and clauses of the constitution are been opposed and the execution thereof obstructed by combinations too powerful to be suppressed by ordinary course of judicial proceedings in the wake of the impending exposition by Ace investigative Journalist Anas Armiyawu Anas, and we shall resist any deviation from the line of impartiality in making sure that video is shown and the relevant culprits are made to face the law should any adverse findings be made against them subsequent upon the exposition.

We are alarmed by the level of allegations of corruption been made against members of the judiciary (judges) who are supposed to be the promoters of our democracy and the last resort for the protection of our rights and liberties. It’s a travesty of justice if judges who are supposed to be the enforcers of the law both by precept and by example are by their very acts caught in disdaining and derogating that very law upon which our democracy is founded upon.

Morality, incorruptibility, fearlessness, assertiveness, truth, fairness and patriotism as well as the fidelity of judges to sacrifice private inclinations for the public good serve as some of the hallmarks of a good judge, but when this sacred truths and trusts are compromised by a judge, then the rule of law becomes a product sold to the highest bidder in the justice delivery system. The chief justice must not be afraid to suffer any damages for her generous exertions for upholding the constitution and the laws of Ghana for he who incurs a loss in its defense shall find a recompense in its liberality.

We wish to thank the chief justice for her swift response in suspending the 22 judges alleged to have taken bribes in the process of administering justice and we encourage her not to renege in her efforts to restore sanctity and respect to the judiciary. The important legal and constitutional objects, which remain to be accomplished by both the President of the republic, the Chief Justice and the judicial council will, we remain persuaded be conducted upon principles equally comprehensive and well calculated for the advancement of the general will, respect and propriety in the judiciary.

We have taken note of the fact that allegations of judicial corruption in Ghana is very rife and every effort at this critical juncture in our democratic journey ought to be used to discountenance what is causing the loss of faith in our Judiciary. The enterprise, intrepidity, and good conduct of Anas Armiyawu Anas as well as his enlightened patriotism are entitled to peculiar recommendations by all patriotic citizens of this country.
