Nana Oseadeayo Agyeman-Badu, the presiding magistrate was bent on hearing the case immediately when he heard of the charge, but he however, rescinded his decision and adjourned the case because the accused defence counsel was not in court.

Prosecuting, Police Chief Inspector Margaret Nunoo stated that on May 17, 2004, a Tema High court issued an injunction restraining work on a building belonging to a Mr Inusah at Klagon near Ashaiman at the instance of the Adjei Kojo Divisional Council of which the accused person is a secretary.

A week later, at about 1300 hours, she said Mr Hamidu was passing by the building when he saw some men working on the land and went to lodge a complain with the Ashaiman police.

While Mr Hamidu and others were before the Ashaiman Crime Officer at his office the accused entered and without any provocation attacked and slapped him (complainant).

Chief Inspector Nunoo said he immediately lodged a complaint and he was issued with a medical report form to attend hospital, while the accused was arrested.
