A 35 years old farmer has been slapped to fifteen (15) years imprisonment in hard labor by the Tarkwa Circuit Court for defiling a 13year old girl.

The accused person Emmanuel Kwame Baffo pleaded guilty.

Prosecuting, Detective Chief Inspector Oscar Amponsah told the court presided over by Mr. Justice Obeng Asante that the complainant is a unite committee member at Kofi-Gyan village whilst the victim is a 13years old school drop- out residing with her mother and a step-father.

He said the accused Emmanuel Kwami Baffoe is a farmer and the step-father of the victim. Kwami Baffoe resides with the victim and her mother at a cottage near Kofi-Gyan. Also the victim has being staying with the father for about a year now without attending school.

He narrated to the court that on Sunday 17th May, this year, the mother of the victim left to the nearby farm to harvest banana and left the accused, their one year old daughter in the care of the victim.

Chief Inspector Oscar Amponsah said when the child slept, the accused person went into the room and propose love to the victim but she refused and said she can’t share him with her mother but the accused ignored her plea and forcibly had sexual intercourse with her and warned her not to inform anybody about it and promised to buy her something but on Monday 18th May, the victim informed her mother.

When the victim’s mother asked the accused, accused vehemently denied the allegation and even went to buy drink to place a curse on the victim for defaming him so they informed some family members and advice that they should be silent about the matter because of how the accused was behaving.

The Prosecutor said on 26th day of May this year, at about 7:00am, the victim’s mother left the victim and the accused alone in the house and went to Kofi-Gyan village to collect mosquito net. The accused took advantage of the situation and forcibly had sexual intercourse with her.

Later, the accused left to the bush to see his traps so the victim went to Kofi –Gyan village to inform the accuser’s land owner about her ordeal. The man also went to inform the assemblywoman about the case.

Base on this information, the assemblywoman sent some committee members to arrest the accused, which they did.

Chief Inspector Oscar Amponsah said when accused was questioned, he admitted the offense so she called for police assistance and all the parties involved in the case were brought to the station. The accused was re-arrested and when he was interrogated, he admitted having had sexual intercourse with the victim.

The victim was issue with a police medical form to attend Government Hospital for treatment but the victim mother did not do that and went back to the village for lack of funds.

The Prosecutor said on 28th May this year, the mother of the victim was warned to bring the victim to assist investigation. The victim was taken to the government hospital for examination and Dr. Ebenezer Acqua who examined the victim gave his finding as ‘’the hymen had been torn well before this current alleged defilement’’.

According to the Doctor the victim had previous vaginal penetration more than once. Investigation cautioned statement was obtained from the accused and after investigation, charged with the offense.
