A former Attorney General and lawyer for the former Chief Executive Officer of the National Food and Buffer Stock Company (NAFCO), Godfred Yeboah Dame, has criticised the re-arrest of his clients, Abdul-Wahab Hanan Aludiba and his wife, Faiza Seidu Wuni.
The re-arrest comes shortly after the Office of the Attorney-General withdrew all charges against the couple on Tuesday, May 5, citing fresh evidence.
The case relates to alleged irregularities in the procurement and supply of foodstuffs under the national school feeding programme, with earlier claims of a financial loss of about GH¢78 million to the state.
The accused persons were released on Wednesday after 24 hours in the custody of the Economic and Organised Crime Office (EOCO).
Speaking on Accra-based JoyNews’ AM Show on Thursday, Yeboah Dame claimed the prosecution relied on the same charges that had earlier been withdrawn.
“The same old charges that were withdrawn were the ones that were read to them after their release,” he said.
According to him, the prosecution’s actions amount to intimidation and harassment rather than a legitimate legal process.
“And so clearly, I think what happened there was only an attempt to intimidate, harass and torture them,” he stated.
The former Attorney General argued that there is currently no active case pending before any court against his clients.
“Clearly, as we speak, the claim of the finding of fresh evidence has been roundly established to be false,” he stressed.
The former Attorney General also indicated that his legal team may consider pursuing legal action over alleged violations of his clients’ rights if the situation persists.
He said they would first cooperate with investigators to understand the basis of the latest interrogation before deciding on the next line of action.
