Lawyer Andy Appiah Kubi has indicated that he will file a notice of withdrawal after the Criminal Court dismissed his application seeking leave to withdraw from representing Bernard Antwi Boasiako, popularly known as Chairman Wontumi, in the ongoing Samreboi illegal mining case.
Speaking to journalists after the ruling, Appiah Kubi said his next course of action would be to formally remove himself from the case.
“My next step is to file a notice of withdrawal to take myself out of the case,” he stated.
Criminal Court 4 dismissed the motion, ruling that it was not supported by any rule of court or established judicial authority.
The court held that in criminal proceedings, a lawyer does not require the court's permission to withdraw legal services, as such a decision is a matter between counsel and the client.
The court further noted that the application had not been served on Chairman Wontumi, a factor it considered significant in arriving at its decision.
Despite the development, the court maintained July 3, 2026, as the date for judgment in the case involving Chairman Wontumi and two others over allegations linked to illegal mining activities in Samreboi.
The court, however, granted an extension of time for parties to file any final written addresses, directing that all submissions be lodged on or before June 24, 2026.
