
The Sekondi High Court has lifted the injunction that barred Joana Gyan Cudjoe, the National Democratic Congress (NDC) parliamentary candidate for Amenfi Central, from contesting in the upcoming election.
The ruling, delivered on Monday, November 11, marks a significant victory for the NDC and its candidate as the December 7 general election approaches.
The decision comes after the NDC filed a request for the court to set aside the injunction and dismiss the substantive disqualification case against Joana Gyan Cudjoe. The case was presided over by His Lordship George K. Gyan-Kontoh.
Previously, the court had postponed the hearing following an appeal from Edudzie Tamakloe, one of Joana Gyan Cudjoe's lead counsels.
Edudzi Tamakloe argued that any further delay in resolving the matter could disenfranchise his client and hinder her participation in the parliamentary race.
Recognising the urgency of the situation, His Lordship Gyan-Kontoh agreed to review the substantive disqualification case and urged both parties to consider an out-of-court settlement. However, the attempt to reach an amicable resolution did not succeed, prompting the court to proceed with the ruling.
In today’s verdict, the Sekondi High Court vacated the injunction, paving the way for Joana Gyan Cudjoe to continue her campaign as the NDC candidate for the Amenfi Central seat.
Following the court's decision, NDC General Secretary Fifi Fiavi Kwetey expressed his delight on social media, saying, “Victory for Joana Gyan Cudjoe! The Sekondi High Court has granted our motion to vacate the interlocutory injunction against our Amenfi Central candidate. Madam Joana Gyan Cudjoe is now free to contest the 2024 elections. Together, we work towards a resounding victory on December 7.”
With this ruling, Joana Gyan Cudjoe’s path to contesting the Amenfi Central parliamentary election is now clear, and she remains a strong contender as the campaign season enters its final stretch.
The NDC is expected to rally behind her in their push for electoral success in the constituency.
