Helsinki. A Finnish appeals court on Thursday reduced the prison sentence of Biafra separatist figure Simon Ekpa from six years to four. The conviction itself stands.

The East Finland Court of Appeal found that Ekpa, 41, had taken part in the activities of a terrorist group and publicly incited crimes for terrorist purposes. The Päijät-Häme District Court had first sentenced him to six years on 1 September 2025.

Ekpa's defence argued that southeastern Nigeria was experiencing an internal armed conflict, and that international humanitarian law rather than Finnish terrorism legislation should apply. The court rejected the claim that this removed terrorist intent.

It did treat the circumstances as relevant to sentencing. It noted that the situation in the Biafra region closely resembled a civil war but did not meet the legal definition of one. It also said the circumstances were close to those in which grounds for exemption from criminal liability, such as civil war, self-defence and necessity, could apply.

The ruling went against the prosecution's position. Prosecutors had also appealed, arguing the six-year term did not reflect the seriousness of his offences. The district court had accepted that Ekpa acted from Finland as supreme commander of several armed groups in southeastern Nigeria. He has been in custody since November 2024.

The verdict is not final. Both Ekpa and the prosecution can seek permission to appeal to Finland's Supreme Court.

For Nigerian readers, the ruling is a legal and political marker.

It shows that a European court will prosecute incitement and command of armed groups abroad under terrorism law. It also shows that the court weighed the conflict context when setting the sentence, though it did not accept it as a defence.
