The claim by the Office of the Special Prosecutor (OSP) that the Attorney-General’s Office has repeatedly rejected requests to collaborate on cases is “completely false”, Deputy Attorney-General and Minister for Justice, Dr Justice Srem-Sai, has said.
His response follows comments by the OSP’s Director of Strategy, Research and Communications, Samuel Appiah Darko, who said the OSP had on several occasions approached the Attorney-General’s Office to collaborate on cases but had been turned down.
Darko made the claim on JoyNews’ Newsfile on Saturday, August 29, while addressing concerns about the relationship between the OSP and the Attorney-General’s Office.
He said although the OSP generally had a good working relationship with the Attorney-General and other stakeholders, there had been instances where requests for case-specific collaboration were rejected.
However, speaking to the media in Accra on Monday, August 31, Dr Srem-Sai said no such request had been made to the current Attorney-General since the government assumed office.
“I do not think there’s any situation where they have approached us to collaborate on anything. And like I said, he didn’t just say one. He said they’ve approached the AG several times on some big issues, and there were ten now. Complete falsehood,” he said.
Dr Srem-Sai argued that the Attorney-General’s Office is the lead law enforcement institution and that the OSP and other agencies operate within a legal framework that places them under its oversight.
“We are the lead law enforcement agencies. OSP and all the other agencies are under us. And recently, the Supreme Court held that they are supposed to be accountable to us because they are using our power,” he said.
Dr Srem-Sai further noted that the claim could be based on engagements involving a previous Attorney-General, rather than the current administration.
He said since the current government assumed office, he was not aware of any instance in which the OSP had approached the Attorney-General’s Office to collaborate on a matter.
