The Ghana Railway Development Authority (GRDA) has warned the public not to purchase or lease railway lands and buildings from individuals without first obtaining official approval from the Authority.
The caution follows reports that some individuals, including former employees of the defunct Ghana Railway Company Limited (GRCL), are allegedly engaging in the illegal sale and lease of railway properties in parts of the Western, Western North and Ashanti regions.
In a statement issued on Wednesday, July 29, the GRDA said the reported transactions were being undertaken without its authorisation and therefore violate the laws governing the administration and disposal of railway assets.
According to the Authority, the alleged activities are in breach of the Railways Act, 2008 (Act 779), as well as the Public Financial Management Act, 2016 (Act 921).
The GRDA further disclosed that investigations have revealed attempts by some individuals to backdate transaction documents in an effort to create the false impression that the transactions were legitimate.
“The GRDA categorically states that such transactions are unlawful and will not be recognised by the Authority,” the statement said.
The Authority emphasised that it will not validate or regularise any lease agreements or transactions involving railway lands and buildings that were executed without its approval.
It also noted that such dealings contravene government policies regulating the disposal of public lands and state-owned assets.
The GRDA has therefore advised prospective buyers and tenants to conduct the necessary due diligence by verifying the status of any railway property with the Authority before entering into any transaction.
“Any person who engages in such unauthorised transactions does so entirely at his or her own risk,” the Authority cautioned.
The statement added that the GRDA is collaborating with relevant state institutions to investigate the alleged illegal activities and will take legal action against anyone found to have engaged in the unlawful sale or lease of railway properties.
The Authority reiterated that only transactions duly approved by the GRDA are recognised as valid.
