Mr. James Gyakye Quayson whose election as Member of Parliament (MP) for Assin North was declared unconstitutional by the Supreme Court (SC) has said declared his intention to contest the Assin North seat in the upcoming by-election.

According to Mr Gyakye Quayson, he is determined to continue serving the people of Assin North with all his “heart, soul, body and all the resources” he can muster for the benefit of constituents.

In a statement issued on Thursday, 1 June 2023, declaring his intention to contest the Assin North by-election, Mr Gyakye Quayson noted he was truthful when he declared on his Nomination Forms in October 2020 that he owed no allegiance to any other country than Ghana.

He indicated that: “To date, no one has provided any evidence,” that he owed allegiance to Canada at the time of filing his nominations and when he was elected and sworn in as MP.

Mr Gyakye Quayson further indicated he is “waiting to read the full judgment of the Supreme Court, whenever it is made available, but there is no doubt that the decision, as announced on 17th May, 2023, flies in the face of many previously decided cases.

“We wait to see whether the words of the various Justices which I have quoted will be respected by the pane.”

He revealed that his priority as of now is to contest and win the Assin North seat for the main opposition National Democratic Congress (NDC).

“Let me make it clear to everyone that the most important thing to me right now is to contest and win the by-election which is the result of what the Supreme Court announced on 17th May, 2023. I am determined to continue serving the good people of the Assin North with all my heart, soul, body and all the resources I can muster for the benefit of my constituents,” he declared.

Mr Gyakye Quayson expressed gratitude to the constituents of Assin North for the support given him since his election was declared unconstitutional by the Supreme Court.

“I have been deeply touched by the amazing support and encouragement from you in the constituency after the Supreme Court decision on 17th May, 2023. I was particularly moved by your show of love and support through the vigil organised by the youth at Assin Bereku on Sunday 28th May, 2023. The massive attendance showed the depth of the support and encouragement I am receiving,” he noted, and stressed: “I was really touched.”

Mr Gyakye Quayson urged the people of Assin North to vote in the by-election to enable him continue the work he began for them.

“The will of the people of Assin North must triumph. Democracy must be restored. I urge you all to come out in your numbers to vote for me so I return to Parliament and continue the work I began to do on your behalf, towards advancing the Assin North development agenda,” Mr Gyakye Quayson added.

The Supreme Court by unanimous decision ordered Parliament to expunge the name of James Gyakye Quayson as MP.

The Court on Wednesday, 17 May 2023, declared as unconstitutional the election of Mr Gyakye Quayson as MP for Assin North.

A resident of Assin Bereku in the Central region, Michael Ankomah Nimfa dragged Mr Quayson to the court to restrain him from holding himself as MP after a Cape Coast High Court in July 2021 annulled his election as Assin North MP.

The petitioner had prayed the apex court that James Gyakye Quayson’s continuous stay in office despite a High Court Judgment annulling his election offended the constitution, and was not fair to the people of Assin North.

The Cape Coast High Court had ruled that Mr Quayson owed allegiance to another country other than Ghana at the time of filing his nomination forms to contest the 2020 polls.

The embattled MP had been challenging the decision by the high court at the supreme court.

Meanwhile Parliament has since written to the Electoral Commission (EC) declaring the Assin North seat vacant.

The EC has subsequently scheduled a bye-election to be held in Assin North on Tuesday, 27 June 2023.
