The Injunction On Akuse: Is Kulape A Rambo On A Rampage???

Where Is Mahefalor Nene Kwesitsu Azaglo When We Need Him Most????

Just when we all thought the Akuse boundary dispute had been resolved once and for all, and the Krobos and their Osudoku tribal brothers will smoke peace pipe, the issue has resurfaced again. Kulape Natriku and his cohorts has succeeded once again in bringing pain and agony into the hearts of the Krobo people.

Kulape; an Osudoku man, whom has always being AN ALBATROSS ON THE NECK OF THE KROBOS, has gone again to the Supreme Court of Ghana to place an injuction on the impending Lower Manya Krobo Municipal Assembly Elections in Akuse.

These six Electoral areas in Akuse are SALON, ZONGO NEW TOWN, AKUTUE, OSORKUTU, AMEDEKA, and BUNGALOW. This is the fifth (5th) time that our Osudoku brothers have taken us to court over Akuse. The Chiefs and people of Manya Krobo will be filing a motion on Tuesday 26th November at the Supreme Court.

A FLASH BACK
In November 2010, a Parliamentary Sub-Legislating Committee, acting on the Local Government (Creation of New District Electoral Areas and Designation of Units) Instrument, 2010 (LI 1983), realigned six electoral areas — Zongo New Town, Akutue, Osorkutu, Bungalow, Amedeka and Salon — all at Akuse, originally part of the Lower Manya Krobo District in the Eastern Region, to Dangme West in the Greater Accra Region.

Consequently, two individuals, Mr Charles Mate Kole and the late Nene Azaglo Kwesitsu I, sued the Electoral Commission (EC) and the Attorney-General, challenging the creation and specification of the new electoral area by the Ministry of Local Government, which was gazetted in November 2010.This blunder had consequently sparked off a fierce legal battle between the Krobos and Osudoku at the Supreme Court of Ghana.

However, on the 13th of June 2012, Justice William Atuguba; the Presiding Judge of the nine member Jury of the Supreme Court, declared Krobos victors over the Akuse land dispute.

Since then, the Lower Manya-Krobo Municipal Assembly have being without Assembly members in spite of the incessant appeals by the Krobos for the elections to be organized.

Finally, in the third week of October 2013, the date for the elections has been announced and posters of the various aspirants have been out. Then Kulape and his people have thrown another bomb again!!!!

What At All Is Their Case This Time Around???
A document which has been intercepted by Kloma Hengme reveals that, among other reasons, their legal team are saying that, per the ruling of the Supreme Court in 2012, the Court did not rule that the affected areas be retained as part of Lower Manya Krobo.

Quoting a section of the 2012 Supreme Court of Ghana Law reports (page 224 to 258) to back their claim, they said the said ruling in its conclusion stated that “ FOR THE REASONS GIVEN, WE DO NOT DECIDE THE DISTRICT OR REGION TO WHICH THE DISPUTED AREAS BELONG. THAT CAN BE LITIGATED BY THE APPROPRIATE LEGAL PROCESSES IN THE LIGHT OF OUR FOREGOING REASONS”. To this, Kulape and co have petitioned the Supreme Court and have succeeded in placing injunction on the elections at Akuse.

But a quick question that Kloma Hengme will pose is that, if Akuse does not belong to Manya Krobo, how come the 2012 General Elections have been held in Akuse under Lower Manya Krobo Constituency??
