Red Bull Wins a Reprieve in India, but the "Energy Drink" Fight Is Not Over ‎

An Indian court has handed Red Bull a reprieve in its dispute with the country's food regulator. The win is narrower than it first sounds. On Tuesday, the Delhi High Court quashed the Food Safety and Standards Authority of India's order directing the company to stop calling its product an "energy drink".

Justice Amit Mahajan ruled on a limited ground: FSSAI had not followed the principles of natural justice when it issued the 30 June 2026 order, because Red Bull was never given a chance to respond.

Crucially, the court did not decide whether Red Bull may legally use the term. It said FSSAI can reconsider the matter and issue a fresh order after a show-cause notice and a hearing. The regulator's position is that India has no separately prescribed standards for energy drinks.

Such products are regulated as caffeinated beverages, and FSSAI argues that the label may not accurately reflect their recognised classification.

The stakes are commercial as well as legal. The directive affected several major brands, including Red Bull, PepsiCo's Sting and Adrenaline Rush, Monster, and a Reliance-owned brand. The category is projected to be worth $1.6 billion by 2028.

Red Bull's India unit argued that the "abrupt prohibition", without any change to the underlying product standard, creates substantial regulatory uncertainty and threatens its existing and planned investments. It also said the order ran against India's stated policy of giving businesses greater certainty.

The case sits within a wider enforcement drive. Reuters reports that Red Bull is one of several globally recognised brands to have sued the Indian regulator in recent months amid unprecedented food-standards enforcement, including surprise raids that have affected companies such as Diageo.

India is not the first to question the language: Pakistan's Punjab Food Authority previously called the word "energy" scientifically misleading and ordered it removed from labels.

The deeper question is who gets to decide what a category name means.

Brands compete on the promise of what a drink does, not only on taste, and regulators must decide whether that promise is a fair description or a claim needing evidence.

Both sides have a point. Companies need predictable rules before they invest, and consumers, especially young ones, deserve labels that do not overstate what a caffeinated drink delivers.

The court has sent the dispute back to where it belongs: a process in which the regulator states its case and the company answers it.

For now, Red Bull can keep the label. Whether it can keep it after a proper hearing is the real test.
