SUBJECT: Structural Governance Briefing: Optimizing Act 1154, Independent Fiscal Council Protections (Act 1136), and Intergenerational Equity Ahead of the 2027 Budget Statement
1. Purpose
This memorandum formally submits the attached policy brief, “The Digital Gold Rush: How Act 1154 Re-engineers Ghana’s Mineral Financing and Infrastructure for Intergenerational Prosperity,” for the Committee’s immediate review ahead of the 2027 Budget Statement on Thursday, 12th November 2026. The objective is to provide actionable recommendations for the legislative enforcement of fiscal discipline, tokenized resource mobilization, automated land remediation, and targeted senior citizen social protections.
2. Key Structural Context for the Committee
As the Committee reviews the upcoming executive budget, four critical legal and economic thresholds must be rigorously policed:
- Enforcement of Act 1136 Macro-Rules: The Committee must ensure strict compliance with the Public Financial Management (Amendment) Act, 2025 (Act 1136), legally binding the state to a 45% debt-to-GDP ceiling by 2034 and a 1.5% annual primary surplus target.
- Fintech Capitalization under Act 1154: To capitalize on the Virtual Asset Service Providers Act, 2025 (Act 1154), the Bank of Ghana has set a strict minimum capitalization baseline of GH¢2,000,000.00 with a minimum of 30% equity reserved for a natural Ghanaian citizen. This requires targeted oversight to protect indigenous innovators from being crowded out by multinational networks.
- Defusing Youth Unemployment: With youth unemployment standing at 21.9% and 1.95 million young Ghanaians classified as NEET, the proposed $10 billion New Economy investment plan must be structurally monitored to absorb a targeted 350,000 graduates annually through the 24-Hour Economy framework.
- Addressing Senior Citizen Vulnerability: Following international benchmarks like Canada’s Property Tax Deferment Program and Panama’s Pensionado program (granting up to 20% off medical consultations and utility relief), the Committee must mandate that the upcoming budget explicitly outlines ring-fenced protections and health screening access under the "MahamaCare" allocation for our elderly.
3. Direct Legislative Directives Submitted for Committee Action
- Ring-Fencing State Guarantees: Mandate that the GH¢400 million allocation for the Women’s Development Bank is completely ring-fenced with explicit first-loss state guarantees to lower commercial borrowing costs.
- Automating Land Reclamation: Coordinate with the Minerals Commission to legally require all small-scale mining concessions to integrate blockchain-secured smart contracts that automatically direct a 3.0% transaction split into an environmental escrow, verified via EPA satellite telemetry before contractor disbursement.
- Enforcing Hiring Audits: Introduce a legislative clause requiring any local firm receiving tax exemptions under the New Economy framework to submit verified quarterly data proving a minimum 15% increase in formal youth hiring.
