Narrative Hook
CEO of GoldBod, Mr Sammy Gyamfi and his cohorts must be educated that the Constitution is supreme so under Protection of Rights of Life under the 1992 Constitution especially at Clause (2a) of Article 13 of the 1992 Constitution, one can cause the death of a person in defense of a property hence land etc. and no court can punish the affected person. Infact it is the dead body of the trespasser which must be caned as punishment.
CEO of GoldBod, Mr Sammy Gyamfi must also be educated that, Mining Rights through Small Scale Mining License is a precondition and not after thought under Section 9 and Section 82 of Minerals and Mining Act 2006 (Act 703).
The very loud applause to the CEO of GoldBod’s irresponsible statement by the participants at the meeting with the CEO, allegedly as members of the Association of Licensed Small Scale Miners as disclosed by the PRO of GoldBod to the General Manager of Channel One TV, should cause a dead man, or a reasonable person to rise up and immediately demand the President of Ghana as the National duty bearer, to Declare a State of Emergency at the affected illegal mining areas and Review Laws on the Mining especially Small Scale Mining.
Otherwise the Chief of Staff in the Office of the President or the President of Ghana himself as the Nation’s duty bearer, who took the Presidential oath to defend the Constitution and laws of Ghana at all times, must call the CEO of GoldBod to order and direct him to render unqualified apology to the good people of Ghana for the irresponsible statement.
Introduction
On the front burner is an irresponsible statement by the indefatigable and hardworking CEO of GoldBod, namely Lawyer Mr Sammy Gyamfi Esq: that illegal Small Scale Mining can be conducted at places with the exception or outside what is termed as the Red Zone Areas in the Mining Sector (as rivers or water bodies and forest) and roadsides and to be formalized through registration at a later time.
Before the topic is expatiated on, retired Major Mohammed Bogobiri, the writer wish to declare that he is on Ghana First, through a Better Ghana Agenda for the current and future generations. So once again, Lawyer Mr Sammy Gyamfi should be commended for the good work he is doing for the State, as CEO of GoldBod. Google and read ‘’The Clash for the Billions: how Dr Bawumia and Mr Sammy Gyamfi share credits for the economic gains and any blame for the loss in BOG’s books by retired Major Bogobiri.
Enter the topic, namely Lawyer Mr Sammy Gyamfi’s irresponsible statement on the front burner which seemed to suggest that he has committed a very serious crime against the interest of the State, since the statement is a recipe for lawlessness. The reason why his immediate boss as the Minister of Finance or Chief of Staff or the President of Ghana and the Commander-in-chief of the Armed Forces of Ghana must quickly reject this irresponsible statement by a Subordinate Officer.
The matter is very serious, if one takes note of the very loud applause to the irresponsible statement by the participants at the meeting with the CEO, allegedly as members of the Association of Licensed Small Scale Miners as disclosed by the PRO of GoldBod to the General Manager of Channel One TV. SO, this should cause a dead man to rise up and demand a Declaration of State of Emergency at affected illegal mining areas and Review of the Mining Laws. Google and read Retired Major Bogobiri article on a Declaration of State of Emergency at affected illegal mining areas and Review of the Mining Laws.
Hmm another very serious matter was the PRO of GoldBod connecting the irresponsible statement by his boss as was same mission of the Eight heroes, who died in the helicopter crash in August 2025. I listened to the talks by Government delegation for the forum in August 2025; I was shocked to my bone marrow, by the illegal talks by some of the Government Officials.
So, these narratives by the CEO of GoldBod and the PRO of GoldBod that has contributed to the newly elected Chairman of the stable of the NDC in Fomena Constituency in the Ashanti Region that he will facilitate illegal mining in Fomena. The combined effect of these irresponsible statements should make God loving Ghanaians, to rise up and Small Scale demand a Declaration of State of Emergency at affected illegal mining areas and the Review of the Mining Laws. Nothing more.
Thanks to my dear braved northern Sister, Miss Abigail Salami or Mrs Abigail Aboagye, the wife of the late Mr Samuel Aboagye, for mustering the courage to tell the President that the only way her Husband and the seven other heroes can be honored is by decisive and swift actions by the President against illegal mining
The late Mr Samuel Aboagye, was my good friend and brother at Obuasi. The family was my associates in Obuasi. The father of Mrs Abigail Aboagye Mr Salami, was the brother to one of my grandmothers, namely the late Madame Awaleh Kanjarga, from Kadema in the Builsa District. One of my brothers, Mr Bawa Gariba and the Children of Mr Salami grew together in Bolga.
The pickup car of my sister or the family got stolen at the resident of the family in Obuasi, under a security covers of a Private Security Company. It was retired Major Bogobiri who was called upon to conduct incident investigation into the loss. The Guard at the resident was not blamable for the loss since it was parked outside his Area of Responsibility or Beat, since the place was walled with cement block as the perimeter fence, and he was always locked inside to the place (wall). Hence at the blind side of the guard.
Lawyer Mr Sammy Gyamfi his cohorts must be educated on the Mining Laws of Ghana and Constitution of Ghana especially Clause 6 of Article 257 of the 1992 Constitution which says that all minerals in Ghana are the property of Ghana and shall be vested in the President on behalf of and in trust for the people of Ghana.
Based on Constitutional stipulation, the mining laws of Ghana Act 703 were made to obey Clause 6 of Article 257 of the 1992. So Act 703 requires that before mining, one must own mining rights: say Mining Lease for Large Scale Mining and Small Scale Mining License for Small Scale Mining from the designate of the President of Ghana as the Sector Minister. Hence the 1992 Constitution and the Mining law require register first before you mine and not mine first and register later.
So, Lawyer Mr Sammy Gyamfi’s statement was/is to subvert the Constitution and established laws under Section 9 and Section 82 of the Minerals and Mining Act 2006 (Act 703). So the adherence to Section 9 and Section 82 are the preconditions before conducting mining operations.
So mining without mining rights granted by the Sector Minister is explicitly illegal. Once again Lawyer Mr Sammy Gyamfi and his cohorts must be educated that Register first before you mine. So for the Small Scale Mining, the relevant law is at Section 82 of the Minerals and Mining Act 2006 (Act 703), but the irresponsible statement has reversed this law. Hence the crime against the State the (Constitution and mining laws).
Section 99 of Minerals and Mining Act 2006 (Act 703) is very clear to be understood by a JSS pupil that Small Scale Mining with no Mining license by the State is a criminal offence. So in 2019 the regime of President Nana Addo in the fight against illegal mining enacted Minerals and Mining Amendment Act 2019 (Act 995) to ensure severe penalties against illegal mining.
So by the Mining Law of Ghana especially under Section 99 of Minerals and Mining Act which criminalized unlicensed small scale, a severe punishment between 15 years and 25 years is what the hands of a High Court is a tight to act with discretionary powers.
So Mr Sammy Gyamfi, a seasoned Lawyer, telling administrative authorities to allow unlicensed Small Scale Mining is therefore telling them to permit first degree felony, hence DCEs and MCEs to commit a mining crime by abetting. So Ghanaians should now understand the reason for the irresponsible statement by the newly elected Chairman of the stable of the NDC in Fomena Constituency in the Ashanti Region that he will facilitate illegal mining in the Fomena.
Lawyer Mr Sammy Gyamfi must be educated on land titles or ownership in Ghana either Public Land as manage by the Land Commission, Stool Land, owned under Customary law by traditional chieftaincy stool or skin and held in trust by a Chief who holds the allodial title for the Community land is held either as allodial or free hold or lease hold or State Land
Clause 1 of Article 257 of the Constitution is clear all public lands are vested in the President on behalf of and in trust for, the people of Ghana. Clause 4 of Article 257 of the Constitution also confirms the ownership of land not covered under Clause 1 or State lands to be the bona fide assets of to the lawful stool or skin or individuals (persons or Companies). Hence land in Ghana is either vested in the President otherwise the rightful owner as in Ghana’s Land Act 2020 (Act 1036). Clause 1 of Article 258 of the Constitution established the Land Commission to manage public lands and the Stool land to manage private lands
Ghana’s Land Act 2020 (Act 1036) speaks of five titles as follows (a). Allodial Title held by traditional leaders, clans and families, (b). Freehold held by individuals or Companies provided they are citizens of Ghana derived from allodial or vested land grants (c). Lease hold held by individuals companies and foreigners, (d) Vested State Land held by the government/Land Commission. (e). Customary tenancy/Usufruct held by community members and traditional farmers
So, Lawyer Mr Sammy Gyamfi’s statement also calls for a disregard to land ownership as stated above who his permission is since ownership requirements include registration with Land Commission. Also for mining, there are the requirements of other clearance especially under section 18 of Act 703 on the requirement of a permit from EPA permit as a precondition before mining.
So, the statement of the CEO of GoldBod is highly problematic under existing mining laws. Since Act 703 explicitly mandates that no person can carry out prospecting, exploration, mining on any land unless granted with mining rights by the Sector Minister. ‘
This hold true even if the person legally holds the title to the land. Since the Small Scale Mining law at Section 82 of Act 703 says small scale mining requires a license, so mining without permission and inspection thus ignores the right of the owner of the land to his property and peasant farmers, local communities and restricted lands (public infrastructure including VRA or GRIDCO pylons, GAS pipelines of Ghana Gas Company, Railway lines, Hospitals etc.) or town or village areas.
Mr Sammy Gyamfi and his cohorts must be educated that under Clause (2a) of Article 13 of the 1992 Constitution, one can cause the death of a person in defense of a property hence land etc.
The constitution of Ghana and the laws of Ghana are written in simple English to be easily understood by all including a pupil of JSS. The President of Ghana took a Presidential oath to obey the Constitution and the laws of Ghana at all times, hence as a duty bearer of the State he must ensure the Citizens especially his appointees act according to the Constitution and laws of Ghana.
So no one especially an Officer of the State must condone with lawlessness. Hence, the CEO of GoldBod who seemed to be doing a good job for the State must render an unqualified apology to the good people of Ghana otherwise the President as the duty bearer must act quickly to rectify the this irresponsible act by his designated officer.
