NDC Lawsuits seeking interpretation of presidential terms not an NDC agenda – Kutor

NDC National Executive Committee Member Wonder Victor Kutor has rejected claims that the ongoing legal challenge seeking an interpretation of presidential term limits is part of a broader agenda by the governing National Democratic Congress (NDC).

One of the cases filed by Daily Searchlight editor Kenneth Kwabena Agyei Kuranchie seeks an interpretation of Article 66(2) of the Constitution.

The provision states that a person “shall not be elected to hold office as President of Ghana for more than two terms.”

The case, among other things, seeks clarification on whether a president who has served one term, lost a subsequent election and later returned to office can serve two further consecutive terms.

The issue has triggered political debate because President John Dramani Mahama previously served as President from 2012 to 2017 before returning to office in January 2025.

There have also been claims that the petition before the Supreme Court seeking an interpretation of Article 66 of the 1992 Constitution is aimed at creating a pathway for President John Dramani Mahama to seek another term in office.

However, speaking on Accra-based Channel One TV's Breakfast Daily show on Monday, September 7, Kutor said the legal challenge should be treated as a constitutional matter rather than an initiative of the NDC.

“The NDC as a political party did not take the matter to court; a former parliamentary candidate aspirant of the NPP, Ken Kuranchie, took the matter to court,” Mr Kutor said.

“The President himself said that he understands the third term to be two terms,” he stressed.

Mr Kutor further noted that the Supreme Court remains the appropriate institution to provide clarity on the constitutional provision and bring an end to the debate surrounding presidential term limits.
