Private legal practitioner Martin Kpebu has stated that his petition seeking the removal of Special Prosecutor Kissi Agyebeng cannot be dismissed because it contains strong evidence against him.

Mr Kpebu’s petition was formally submitted in December 2025 and alleged, among other things, incompetence on the part of the Special Prosecutor, including his handling of the departure of former Finance Minister Ken Ofori-Atta from Ghana.

Speaking on Accra-based JoyNews’ PM Express on Monday, August 31, the lawyer said the petition has now been put “on ice” following what he described as a political settlement, although he confirmed that it had reached the Chief Justice.

“Mine is not part[of those earlier dismissed by the Chief Justice]. Those that were part, they put that out in the public. Mine is a strong dossier. Don’t joke,” he said.

He further indicated that he would make the contents of the petition public if it is eventually dismissed.

“There’s no way you can throw that petition out. The day that petition will be thrown out, the next day I’ll publish it,” he stated.

The development comes against the backdrop of renewed attention on the OSP following Mr Agyebeng’s declaration on August 26 of a “rebirth” of the institution.

The Special Prosecutor made the declaration after the Supreme Court unanimously upheld the constitutionality of the OSP’s prosecutorial mandate, ending a legal challenge to the Office’s powers.

Mr Agyebeng said the OSP had faced sustained attempts to undermine or shut down the institution but remained committed to its anti-corruption mandate.

The OSP has since announced fresh investigations into the Ghanaian dimension of a US$1 million bribery case involving former Tema Oil Refinery Managing Director Kwaku Asante Berko.
