Netanyahu, the Late Senator Graham, and the Quiet War Against the ICC's Chief Prosecutor

Newly surfaced recordings have pulled back the curtain on how far Israeli Prime Minister Benjamin Netanyahu and the late US Senator Lindsey Graham were prepared to go to blunt the International Criminal Court's pursuit of an arrest warrant against the Israeli leader and the recordings raise uncomfortable questions about the politicization of international justice.

What the Recordings Show
The footage, filmed by British documentary-maker Alex Holder as part of a project following Graham's relationship with Donald Trump and Netanyahu, captures conversations between the senator and the prime minister in the weeks before ICC judges issued arrest warrants against Netanyahu and then-Defence Minister Yoav Gallant in November 2024.

In the recordings, Netanyahu is heard pressing Graham to organize a bipartisan letter from American lawmakers protesting the court's proceedings, framing sexual misconduct allegations against then-Chief Prosecutor Karim Khan as a means of casting doubt on the case against him. Graham, for his part, is heard promising to secure Democratic signatories and later confirming that two Senators Richard Blumenthal and Ben Cardin had been persuaded to sign on.

The material was first reported by The New York Times and has since been corroborated across several outlets, including Middle East Eye and TRT World, which have long tracked what they describe as a broader intimidation campaign against Khan's office over its Gaza war crimes investigation. According to reporting on the recordings, Graham later remarked to Netanyahu that he ought to be compensated "in shekels" for his efforts on the prime minister's behalf a line that has drawn particular attention for its transactional candour.

Timing and Consequences
The bipartisan letter the two men discussed was dispatched on 1 November 2024. It did not, in the end, delay the court: ICC judges issued warrants for Netanyahu and Gallant, alongside three Hamas officials, on 21 November 2024. What the episode did accomplish, critics argue, was to seed a narrative one that Netanyahu and allied officials would repeat publicly that Khan's prosecutorial decisions were compromised by his own alleged misconduct rather than driven by the merits of the Gaza investigation.

That narrative gained fresh weight last week. Khan was formally removed from his post as ICC chief prosecutor after a nearly two-year investigation by the court's oversight body into the harassment allegations, which he continues to deny and has said he intends to challenge. The Graham-Netanyahu recordings have now reopened the question of whether the process that led to his removal was ever fully insulated from the political pressure documented on tape.

Graham died earlier this month, and the recordings have surfaced posthumously as part of Holder's documentary material footage that networks including CNN have since aired, with hosts describing it as a striking window into how personally Graham inserted himself into the defence of an allied head of government facing international prosecution.

Why It Matters Beyond Washington and Tel Aviv
For an institution like the ICC, whose authority rests almost entirely on the perception that its prosecutions are insulated from great-power politics, this episode is corrosive regardless of where one stands on the underlying Gaza case. A sitting senator coordinating letter campaigns with the very head of state under investigation timed to coincide with allegations against the prosecutor handling that investigation is precisely the kind of interference the Rome Statute framework was designed to resist.

It also sits inside a wider pattern: African states, several of which have had fraught relations with the Court over its selective enforcement in the past, will watch closely how the ICC handles the fallout, since the credibility gap this episode exposes cuts both ways it damages the Court's standing as an independent arbiter, but it also lends ammunition to governments elsewhere who have long argued the institution bends more easily to Western pressure than to accountability for African defendants.

Khan's removal, and the questions now surrounding the circumstances of it, will likely feature in debates about ICC reform for some time. Whether the Court can credibly separate a genuine misconduct investigation from a documented political pressure campaign against the same prosecutor may determine how much authority it retains the next time it moves against a powerful state's leadership.
