High Court Throws Out No‑Case Bid; Ex‑GIIF Bosses Ordered to Open Defence in Sky Train Trial

The High Court has dismissed a submission of no case filed by former Ghana Infrastructure Investment Fund (GIIF) CEO Solomon Asamoah and former Board Chairman Prof. Christopher Ameyaw‑Akumfi, clearing the way for the two to open their defence in the ongoing Sky Train trial.

Deputy Attorney‑General Justice Srem‑Sai disclosed the development in a Facebook post on Thursday, July 2, noting that the accused persons had argued that the prosecution had failed to establish a prima facie case against them.

But the court disagreed.

“The Court has since directed them to open their defence and give reasons why they should not be convicted for causing US$2 million loss to the nation,” Srem‑Sai wrote.

The case — officially Republic v Solomon Asamoah & Another — centres on a US$2 million payment made by GIIF in 2019 for an equity stake in a project development company linked to the proposed Accra Sky Train project. Prosecutors say the payment was made without board approval, and the project never materialised, resulting in financial loss to the state.

The ruling follows earlier proceedings in which the court granted Kumi GH¢30 million bail with two justified sureties after months in custody.

With the no‑case submission dismissed, the court has ruled that the prosecution has presented sufficient evidence for the trial to proceed, requiring the accused persons to respond to the allegations.

Justice Srem‑Sai also commended the prosecution team and investigators from the National Intelligence Bureau (NIB) for their work.

The trial now moves into the defence phase as Asamoah and Prof. Ameyaw‑Akumfi seek to challenge the charges against them.
