Andy Appiah Kubi, lawyer for the Ashanti Regional Chairman of the New Patriotic Party (NPP), Bernard Antwi-Boasiako, popularly known as Chairman Wontumi, is reported to have filed an application seeking to withdraw from a criminal case involving alleged illegal mining activities at Samreboi in the Western Region.

According to reports, Lawyer Andy Appiah Kubi has filed an application to cease acting as counsel in the case titled The Republic v Bernard Antwi-Boasiako & 2 Others.

The development comes just weeks before the High Court is expected to deliver judgment in the matter on July 3.

The information was shared in a social media post on Thursday, June 11, by media and legal practitioner Osei Bonsu, after the lawyer revealed the move on his Ekosiisen programme Accra-based Asempa FM.

“Lawyer Andy Appiah Kubi ESQ has filed an application to leave the case of Republic v Wontumi & Ors (Samreboi Case),” Osei Bonsu wrote.

According to him, the application is expected to be moved before Criminal Court 4 on Monday, June 15.

“Andy Appiah Kubi ESQ will move his application and state his reasons for the withdrawal at the Criminal Court 4 on Monday, June 15,” he added.

The reported move comes after the trial officially ended earlier this month when the defence called its fifth and final witness.

The case relates to allegations that illegal mining activities were carried out on a concession at Samreboi without the necessary authorisation.

Prosecutors allege that one Henry Okum conducted mining operations on the concession and used proceeds from the activities to undertake reclamation works on degraded portions of the land.

They further contend that evidence presented during the trial links Chairman Wontumi to the operations.

The defence, however, maintains that the law permits lease holders to engage service providers without transferring mineral rights, citing provisions of the Minerals and Mining Act, 2006 (Act 703) and Legislative Instrument 2176.
