The legal suit placed by Akosua Serwaa at the court is without merit in all the two most important issues regarding the death of a spouse that Akosua seeks a ruling on.
They are:
1. Woy3 Kuna (Recognition as a partner at the funeral of a spouse)
2. Inheritance or sharing of properties of the deceased spouse
1. Woy3 Kuna (Recognition as a partner at the funeral of a spouse)
This is not recognized in law or by the ordinance of marriage, Government marriage, or white marriage. It does not form part of any of the conditions of a foreign or ordinance marriage. It is just a symbolic traditional responsibility of a partner or partners during funeral rites of a departed partner among some ethnic groups in Ghana. Among some ethnic groups in Ghana, baby mamas and baby fathers are even allowed to perform this responsibility.
2. Inheritance or sharing of properties of the deceased spouse
The conditions of ordinance marriage, Government marriage, or white marriage for the sharing of properties of a deceased spouse only come into place when no will for the sharing of properties was left by the deceased.
In this case, it has been learned that Daddy Lumba left behind a will for the determination of how his properties are to be shared.
Based on the aforementioned, it is clear that the legal suit placed at the court by Akosua Serwaa is without merit and would be dismissed by the Court because the court has no jurisdiction to decide on any of the issues above. Note, the sharing of the properties has already been fulfilled by the deceased, and the “woy3 Kuna” aspect doesn’t fall within the jurisdiction of the court.
