The Attorney-General has appealed against a Court of Appeal decision ordering a stay of proceedings in the trial of former National Food and Buffer Stock Company (NAFCo) Chief Executive Officer, Hanan Abdul-Wahab, and his wife, Faiza Sediu Wuni.

The Court of Appeal, presided over by Justice Noble Nkrumah, with Justices Lydia Osei Marfo and George Boadi serving as members of the panel, had granted an application filed on behalf of Hanan Abdul-Wahab and ordered the stay of proceedings.

The application, argued by lawyer Godfred Dame, was upheld after the court determined that it raised exceptional circumstances warranting the stay.

In its ruling, the court also underscored the importance of a charge sheet in criminal proceedings and stressed the need for any challenge to a charge sheet to be determined expeditiously.

The Attorney-General, dissatisfied with the decision, has now filed an appeal challenging the Court of Appeal's reasoning.

The prosecution argues that the court erred in law by holding that a challenge to a charge sheet constitutes exceptional circumstances justifying a stay of proceedings.

Among the reliefs being sought by the Attorney-General is an order setting aside the Court of Appeal's ruling and directing the High Court to resume and continue with the trial of the accused persons.
