Seven Years After Bishoftu: 32 Kenyan Families to Receive $87.3 Million in Boeing Compensation

Nearly seven years after Ethiopian Airlines Flight 302 plunged into a field outside Bishoftu, killing all 157 people on board, the families of the 32 Kenyan victims are set to receive a combined $87.3 million in compensation tied to Boeing's settlements with the US Department of Justice.

The Numbers Behind the Payout
Chicago-based Ribbeck Law Chartered, which represented the families through years of US legal proceedings, said the Kenyan claimants' allocation totals $87,343,352.60, averaging roughly $2.73 million about KSh 350 million per victim.

Manuel von Ribbeck of the firm said the legal work on behalf of clients spanning the United States, Africa, the Middle East and Asia had now concluded, clearing the way for Boeing to release final payments.

That $2.73 million figure, however, is not a single fresh payout but the sum of two separate government-established compensation funds. The first, roughly $1.45 million per victim, came from the $500 million fund created under Boeing's 2021 Deferred Prosecution Agreement with the US Justice Department.

The second, an estimated $1.285 million per victim, flows from a new $444.5 million fund Boeing agreed to establish under a May 2025 non-prosecution agreement, after the company was found to have violated the terms of its earlier deal.

Divided equally on a pro-rata basis among the estates of all 346 people killed in the two Boeing 737 MAX disasters, that newer fund alone accounts for about $41.1 million of the Kenyan families' total allocation.³

A Long Road Through US Courts
Flight 302 crashed on 10 March 2019, roughly six minutes after departing Addis Ababa's Bole International Airport for Nairobi, when a faulty sensor triggered the aircraft's Maneuvering Characteristics Augmentation System (MCAS), repeatedly forcing the plane's nose down despite the pilots' efforts to regain control.

Kenya recorded the highest number of fatalities by nationality among the 30-plus nationalities represented on board, including 32 Kenyans, 18 Canadians, nine Ethiopians, eight Italians, eight Chinese and eight Americans.The disaster followed less than five months after Indonesia's Lion Air Flight 610, another Boeing 737 MAX 8, crashed into the Java Sea in October 2018, killing all 189 people aboard bringing the combined death toll from the two crashes to 346 and triggering a worldwide, 20-month grounding of the 737 MAX fleet.

The Kenyan families pursued their claims through the US federal court system, where they were recognised as crime victims after prosecutors accused Boeing of misleading air safety regulators. The first Kenyan family represented by Ribbeck Law received an initial $3 million settlement in December 2020, separate from the criminal-case funds, with broader payments from the $500 million victim fund beginning by June 2021.

Combined with those earlier settlements, the total financial recovery for Kenyan households from the Flight 302 disaster is now estimated at roughly Sh17.3 billion.

Compensation Beyond the Government Funds

The government-established funds are distinct from the private civil settlements and courtroom verdicts many families have separately pursued against Boeing. In one recent case, the family of a 32-year-old victim was awarded $35.85 million the full jury verdict plus 26 percent interest after Boeing agreed not to appeal, with the company stating it remained "deeply sorry to all who lost loved ones on the two flights."Boeing has said it has resolved the vast majority of claims through settlements, while affirming that families retain the right to pursue damages trials in court.

Compensation figures for victims from countries beyond Kenya have not been publicly disclosed, though Ribbeck Law's work is understood to have touched claimants in more than 35 countries across multiple jurisdictions.
