GBA demands CJ reinstatement, swift action on Bawku conflict and Ablekuma North poll impasse

The Ghana Bar Association (GBA) has issued a five-point resolution addressing significant national and professional concerns, such as the Chief Justice's suspension, the endless Bawku conflict, and the unresolved parliamentary election in Ablekuma North.

The GBA made these resolutions on Saturday, April 26, at its 2025 mid-year conference held at Labadi Beach Hotel in Accra.

The association argued that the President's suspension of the Chief Justice, Gertrude Esaaba Torkonoo, was unlawful.

It contended that President Mahama, who is not a judicial officer, lacks constitutional authority to use such discretion in the absence of a clearly established regulatory framework.

“The Ghana Bar Association calls for the immediate revocation of the suspension of the Chief Justice…in the absence of a published Constitutional Instrument, Statutory Instrument or Regulation(s) governing the exercise of his said discretion as required by Article 296 of the 1992 Constitution,” the statement read in part.

The GBA also called for the release of the full ruling that established a prima facie case against the Chief Justice, noting the importance of transparency and due process.

It also urged for thorough regulations to govern future Article 146 proceedings, as well as condemning politically driven criticism that undermines judicial independence.

On the Bawku conflict, the GBA expressed support for the ongoing mediation efforts led by the Asantehene, Otumfuo Osei Tutu II and urged all parties to cooperate.

“The Association commits to using its voice and platform to advocate for a peaceful resolution and will support any constitutional and legal measures necessary to secure enduring peace in Bawku,” it resolved.

Another major concern was the unresolved parliamentary elections in Ablekuma North, where no winner has been declared months after the December 2024 general elections.

The GBA called on the Electoral Commission and relevant security agencies to expedite processes to resolve the impasse.

“The GBA notes with concern the lack of parliamentary representation for the people of Ablekuma North… and calls on the Electoral Commission…and other relevant authorities to take immediate and necessary steps to resolve the situation,” the resolution stated.

The other two resolutions addressed a call for the reversal of the Acting Chief Justice, Justice Baffoe-Bonnie's decision on court case assignments, as well as an appeal for immediate action against illegal mining, locally known as 'galamsey'.

The GBA called on law enforcement and the judiciary to take decisive action against illegal miners and expedite galamsey-related prosecution to deter future criminals and protect the environment.
