Abena Kwalla fails to appear in court

The former Western Regional Organizer of the New Patriotic Party (NPP), Ms Abena Kwalla failed to appear in court last week Friday to pursue the case she had brought against the Effia Kwesimintsim organizer of the party, Jerry Hanson. The accused has been charged with offensive misconduct.

Though Abena Kwalla was around the Court premises, she failed to take her seat in the Courtroom. The failure of both the prosecution and the complainant to appear in Court compelled Counsel for Jerry Hanson (Accused), Mr. Seth Kwame Awuku to pray the Court to quash the charge levelled against his client.

According to Counsel, the prosecution could not threaten his client's constitutional right and therefore if the prosecution was not ready to go ahead with the case, it should be struck out. The case has been adjourned to 4th July 2008.

The fact of the matter is that Abena Kwalla, the former Western Regional Women's Organizer of the NPP, reported Mr. Jerry Hanson, who is also an NPP party member, to the Police on the grounds that the accused had insulted her.

The Kwesimintsim Police Command, led by ASP Magnus Sam ordered two detectives to arrest Mr. Hanson after the complainant had reported the alleged verbal assault to him.

Even after Counsel had managed to overturn a Court bench warrant issued for the arrest of the accused, the Police under the instruction of Commander Sam still pursued the accused to arrest him. Unknown to the detectives, the lawyer had verified from the court and realised that the bench warrant had been procured fraudulently
