President John Mahama Be Removed from Office For Violating The Constitution of Ghana
The President took the oath of office in January 2025 for the second time, the first time was when he was elected into office in 2013. On 7 January 2025, in his oath he said “I will at all times preserve, protect and defend the constitution of the Republic Ghana”.
On the 22 of January 2025 just a few days after taking the oath of the President, the President publicly violated the constitution of Ghana. The President sworn his appointed ministers into office before publicly advising them to declare their assets. This was a clear violation of the constitution and the President should have known best.
Ghana’s constitution, Article 286 (1) requires a good number of public office holders to submit to the Auditor-General “a written declaration of all property or assets owned by, or liabilities owed by, the public officer whether directly or indirectly – (a) before taking office.
So in this case the ministers must declare their assets before they take office, the President should also make sure all the ministers declare their assets before they take the oath of office, but the president failed to do that basic responsibility.
It is therefore logical to say that some of the ministers did not declare their assets, the reason why the President made that comment. The President went on to say that, the first set of his ministerial appointees should begin the process of declaring their assets and indicated that the Chief of Staff would soon announce a cut-off date by which all eligible appointees must submit their asset declaration forms to the Auditor-General.
The President is competently violating the constitution of Ghana and this reminds me of the famous phrase "incompetent John Mahama" is violating our constitution and members of parliament should initiate an impeachment process against him.
Article 69 - Removal Of President
(1) The President shall be removed from office if he is found, in accordance with the provisions of this article
(a) to have acted in willful violation of the oath of allegiance and the presidential oath set out in the Second Schedule to, or in willful violation of any other provision of, this Constitution.
Based on article 69(1a) the president has violated the provision of the constitution, therefore parliament should initiate the process of removing him from office.
The president's action also shows that he is not ready to fight corruption. Asset declarations is measure to check corruption
I will once remind the president that article 286(1) states that public office holders should declare their assets before taking office. I am disappointed when I watch the president asking them to declare their assets and the Chief of staff will set up a cutoff date. In this case do you need a cut off date? No because once the person is appointed it is a must declare assets before the person starts work.
