OccupyGhana threatens to take legal action against Auditor-General over non-compliance
Pressure group, OccupyGhana has threatened to take legal action against the Auditor-General for failing to comply with its constitutional demand for the surcharging of officials responsible for the illegal use of government funds.
In September 2021, Occupy Ghana wrote to the Auditor-General to request the issuance of disallowances and surcharges to all persons so-identified as having been either engaged in or responsible for the illegal use of government funds in your 2019 and 2020 Audit reports.
After several months, OccupyGhana was forced to write to the Auditor-General again after it received no feedback for the previous letter.
Unhappy with the silence, the group has warned that it will sue the Auditor-General should it fail to provide information on what it has requested.
“If you have issued the disallowances and surcharges demanded, and have not informed us of the action by replying to our earlier letters please do so for the sake of good process and order,” part of a letter from OccupyGhana to the Auditor-General reads.
It concludes, “If, however, you have failed to action our demand to issue the disallowances and surcharges and further failed to provide the information we requested, be informed that we shall commence legal proceedings against you, including filing a petition to the Right To Information (RTI) Commission.”
