Sedina Case: Legal Experts Break Down Court of Appeal Ruling, Evidence and Prosecution Failures

The acquittal and discharge of former Microfinance and Small Loans Centre (MASLOC) Chief Executive Officer, Sedina Tamakloe-Attionu, has triggered renewed debate over Ghana's approach to prosecuting complex financial crimes.
On The Point of View with Bernard Avle, a panel of legal and political experts examined the Court of Appeal's decision, the High Court conviction, the evidence presented and the broader implications for Ghana's justice system.
Private legal practitioner Oliver Barker-Vormawor argued that Ghana's difficulty in securing convictions in financial loss cases may stem from challenges in how charges are framed and how evidence is presented. He referenced previous cases, including the Tsatsu Tsikata case, to highlight recurring difficulties in prosecuting alleged financial loss to the state.
He questioned whether prosecutors sometimes overcharge cases by presenting numerous allegations without clearly linking evidence and witnesses to specific charges.
Manhyia South MP Nana Agyei Baffour-Awuah criticised aspects of the Court of Appeal's judgment, arguing that the judges appeared to focus heavily on what the prosecution failed to do rather than evaluating the evidence before the court.
