As the Supreme Court of Ghana celebrates 150 years, Justice Yonny Kulendi reflects on the institution's history, constitutional mandate, and role in protecting Ghana's democracy.
Speaking on Citi Breakfast, and later rebroadcast on The Point of View with Bernard Avle on Channel One TV, Justice Kulendi explained why the anniversary focuses specifically on the Supreme Court and not the Judiciary as a whole.
He noted that the Supreme Court has survived every coup Ghana has experienced since becoming a republic and has played a critical role in resolving electoral disputes, stressing that it is the only institution mandated to adjudicate presidential election petitions.
Justice Kulendi also addressed public perceptions about judges, rejecting claims that judicial decisions are influenced by politics or presidential appointments. He stressed that judges are guided by the law and evidence, not popularity or political considerations.
On corruption concerns, Justice Kulendi defended the integrity of the judiciary, saying while any corrupt judges must be identified and dealt with, many judges continue to serve with commitment and integrity. He urged Ghanaians to expose attempts to bribe judicial officers rather than enabling misconduct.
He further discussed delays in the justice system, attributing them to procedural, logistical, and case management challenges, while advocating periodic reviews of the Supreme Court's jurisdiction to improve efficiency without limiting citizens' access to justice.
