Supreme Court to rule on portions of suit against GT divestiture

Portions of a law suit against the divestiture of Ghana Telecom (GT) have been referred to the Supreme Court for hearing.

The suit was brought against the government at the height of the controversy over the sale of 70 percent shares in Ghana Telecom to the British firm, Vodafone.

It was instituted by some private individuals who argue the agreement was flawed and illegal.

The Accra High Court hearing the case ruled that the Supreme Court should decide whether the Sales and Purchase Agreement (SPA) with Vodafone can be challenged in court.

The highest court in the land will also have to determine whether procedural or substantive errors in the SPA can be rectified by parliamentary ratification.

Finally, the High Court wants the Supreme Court to decide whether some specified articles in the SPA contravene the 1992 constitution.
