
THE POLICE in Hohoe, Jasikan, Kpando and Worawora, all in the Volta Region, have been cautioned not to illegally get involved in the political machinations in the Biakoye Constituency of the New Patriotic Party (NPP).
The Service could be cited for contempt of court proceedings in an on-going legal battle in the constituency if it fails to tread cautiously.
This was contained in a reminder document to the various divisional and district commanders by Mr. Daniel Owusu-Nyampong of Owusu-Yeboah, Akuffo & Associates, solicitors for the party executive.
The document cautioned the Police not to fall to the antics of the Jasikan District Chief Executive (DCE), Solomon Kwame Donkor, and his associates, who might solicit their assistance in what it described as “illegal political activities in the constituency”.
The document, dated 13th November, 2007, recalled that for as long as an appeal at the Appeal Court and a motion of stay of execution at the Hohoe High Court were yet to be heard, any earlier ruling involving the constituency remained frozen and inoperative.
It noted that the current developments in the party were purely political, some of which were already in court, stressing that it would be needless for the Police to meddle in it and stain its image.
“My instructions are to write to you formerly to bring to your attention the planned arrangements by the said DCE and his associates to draw and involve the Police needlessly in a purely political party matter that is likely to expose the Police to contempt of court proceedings,” it said.
The document stated further that Solomon Donkor and his associates had an intention of taking advantage of a Hohoe High Court ruling to undertake certain illegal political meetings and activities in the constituency, in disregard of the appeal and motion of stay of execution.
“If indeed the DCE and his associates have a legitimate cause to pursue, they ought to use and rely on the court process, and not on Police intervention without any direct authorization from the courts,” the document stressed.
When contacted, the constituency chairman, Mr. Forson Anane-Agyei said the essence of the ploy “is to create the impression that the constituency is not ready for the December 22 national congress”, during which a presidential candidate for the 2008 general elections would be picked.
“I wish to assure the party and all aspirants that Biakoye will be fully represented at the congress. Because of the appeal and motion of stay of execution, my lawyers have made me to understand that the Hohoe High Court Order of Injunction is automatically stayed or frozen in law,” he
