Chief Justice petitioned to Investigate Judge in Rockson Bukari Bribery Scandal

A concern citizen, identified himself as KyeinBaffour has petitioned the Chief Justice, Justice Sophia A.B.A Akuffo to investigate JusticeJacob Boon,the High Court Judge in the centre of the bribery scandal involving former Minister of State, Rockson Ayine Bukari.

In a two page petition addressed to the Chief Justice, Kyei Baffour, premised his petition on the fact that, "a General News Publication on Ghanaweb.com on Tuesday, 18 December 2018 detailing alleged contact or meeting between the Judge and officials of the Shaanxi mining company at the residence of the Judge on November 2018 before final ruling on November 26, 2018 which went in favor of the Shaanxi mining company."

He stated that, he is a citizen of the Republic of Ghana with the Constitutional right to expose and combat crime in the interest of the good people of Ghana, hence the petition to bring fairness in the case, as the motto of the judicial services ofGhana,"Justice and Fair Play."

He is therefore urging the Chief Justice to exercises her powers through the petition and "invoke articles 287(1)(2) and 125(4) of the 1992 Constitution of Ghana to have Justice Jacob B. Boon investigated for his alleged interest in the case of Shaanxi mining company limited and Cassius mining limited."

Dear Sir/Madam,

A PETITION FOR THE INVESTIGATION OF JUSTICE JACOB B. BOON ON THE SHAANXI AND CASSIUS MINING COMPANIES.

I submit before your office, this petition to invoke articles 287(1)(2) and 125(4) of the 1992 Constitution of Ghana to have Justice Jacob B. Boon investigated for his alleged interest in the case of Shaanxi mining company limited and Cassius mining limited.

The petitioner is a citizen of the Republic of Ghana with the Constitutional right to expose and combat crime in the interest of the good people of Ghana.

The basis upon which this petition is brought to your office is as a result of General News Publication on Ghanaweb.com on Tuesday, 18 December 2018 detailing alleged contact or meeting between the Judge and officials of the Shaanxi mining company at the residence of the Judge on November 2018 before final ruling on November 26, 2018 which went in favor of the Shaanxi mining company. The Publication in part indicates that ".......Starr News is sincerely unable to establish whatever took place indoors as the Shaanxi officials visited the Judge privately at least twice within two weeks before the ruling......... Starr News also can neither conclude nor suggest that Shaanxi's multiple visits to the Judge's house influenced the outcome of the case....." With this, I believe it's only your office that can unravel any uncertainties or doubts on the mindset of those who patronize the services of the judiciary; having in mind Ghana's code of conduct for Judges and Magistrates, under Rule 2 and 5 which stresses the need for Judges to avoid whatsoever might cause their impartiality to be reasonably questioned or erode public confidence in the judiciary. I do consider the allegation about the encounter between the judge and the mining company as something that ought to be investigated to restore the continue confidence in the judiciary in dispensing Justice.

I humbly beseech your office, to have this matter investigated, having regard to the motto of the judicial service of Ghana "Justice and Fair Play". Attached is the said Publication on Ghanaweb.com(General News Tues, 18 Dec 2018) marked as Exhibit K and a transcript conversation between a Minister of State and the investigative journalist in a plea to drop the publication against the Judge, marked as Exhibit M (General News Mon, 29 April 2019) and a resignation letter by the said Minister of State at the Presidency to that effect, marked as Exhibit L.
