The European Union Must Implement The Decisions Of EU Court Of Justice

With reference to the article entitled “European Court of Justice Must avoid a row with Morocco” signed by Jean-Claude Martinez and published by Modern Ghana on February 17, 2018, the Embassy of the Saharawi Republic to Ghana would like to draw your kind attention on the following facts:

1-Professor Jean - Claude Martinez, former vice-president (1985 to 2008) of the xenophobic and anti-european French National Front of Jean-Marie Le Pen, acts as a lobbyist of the Kingdom Morocco. The French Magazine Valeurs Actuelles” published the same text on February 12, 2018. The author of the said article, in line with the policy of former European colonial powers, pretends to justify and defends the illegally plundering of the natural resources of the Saharawi people. This behaviour is ethically rejectable, morally inacceptable, politically incorrect, and legally unfair.

2-On December 21, 2016, the Court of Justice of the European Union stated that “the association and liberalization agreements between the EU and Morocco are not applicable to Western Sahara because of the separate and distinct status guaranteed to the territory of Western Sahara under the Charter of the United Nations and the principle of self-determination of the peoples”. (Please find attached the Communique of the European Court of Justice).

3- On next 27^th of February, 2018, it is expected that the European Court of Justice will announce its final decision on the fishery agreements between EU and Morocco. The advanced conclusions made by the Advocate General of the same Court has created panic scenes into the ranks of the looters, the offenders and, their fans. (Please find attached a resume of the conclusions of the Advocate General).

4-Western Sahara question is scheduled in the agenda of decolonization of the UN General Assembly since 1963 and in 1991 the UN Security Council has deployed on the ground the United Nations Mission for the Referendum in Western Sahara (MINURSO). The intentional distortion and spiderweb of topics in which the author wanted to dilute an extremely recognized and clear matter of decolonization and self-determination, as is the Western Sahara issue, gives the impression that we are facing a case of soldier of fortune.

5-Proclamed in 1976 after the sudden abandonment of the territory by the Spanish colonial power, the Saharawi Republic is a founder member of the African Union.

6-The European Union must respect the International Low and implement the decisions adopted by the European Court of Justice on 21 December 2016.

7-Finally, and metaphorically speaking we have to say that…doves are usually symbols of peace while vultures are synonymous with carrion, including human remains, resulting of the true big catastrophes like colonial and occupation wars.
