Gideon Laryea, a property agent who was accused of defiling his 10-year-old niece at Osu has been admitted to bail by an Accra Circuit Court on Wednesday.
Laryea who was reported to have admitted inserting his finger into the victim's vagina but denied having sexual intercourse with her, was admitted to bail in the sum of GH¢40,000.00 with three sureties.
Charged with two counts of defilement, Laryea pleaded not guilty and was to reappear on February 2 before the court presided over by Mrs. Abena Oppong Adjin-Doku.
Laryea's lawyer, Mr Paul Asibi Abarigah who moved the motion for the bail application told the court that his client had a fixed place of abode and he had not had any brush with the law.
According to defence counsel, Laryea, a Ghanaian had people who would stand surety for him.
Counsel held that the court had the powers under the law to admit the accused person to bail as he was ready to abide by the bail conditions of the court.
Chief Inspector Kofi Atimbire who held the brief of Deputy Superintendent of Police (DSP) Adolphine Dzansi, the substantive Prosecutor in the case did not opposed the bail application.
The Prosecution said the complainant is a 30-year-old trader residing at Osu with her 10-year-old daughter, who is the victim in the case.
DSP Dzansi said the victim however spends the weekends with her paternal grandmother in their family house at Osu.
According to the prosecutor, Laryea who is an uncle to the victim resides in the family house sharing a chamber and hall with his father.
The Prosecutor said Laryea normally does his laundry on Sundays and investigations revealed that Laryea often invites the victim to come and sit by him whiles washing.
Laryea would then gave his phone loaded with nude pictures to the victim to watch and subsequently, 'sent the victim to his father's room, suck her breast, inserted his fingers into her vagina and have sexual intercourse with her,' the Prosecution told the court.
The Prosecution said the victim since August last year has endured the ordeal to date.
According to the Prosecution, further investigations revealed that on December 2, last year, at about 10:00 hours, the complainant sent the victim to her grandmother, there Laryea called her, fondled her and had sexual intercourse with her on a bed at where he usually does his washing.
The same day, the Prosecutor said the complainant noticed blood stains in the victim's pants and thought she had menstruated.
On December 11, last year, at about 06:00 hours, the complainant noticed blood stains again in the victim's pants and quizzed her.
'It was there that the victim broke down and told her that accused has been fingering her and having sexual intercourse with her anytime she goes to her grandmother's place,' the Prosecution said.
The Prosecution said the complainant informed her husband and the accused person was arrested and brought to the Domestic Violence and Victims Support Unit (DOVVSU), Accra where a medical report form was issued to the victim.
The Prosecution said Laryea in his cautioned statement admitted inserting his finger into the victim's vagina but denied having sex with her.
