Defense Suffers Another Setback

Lawyers representing Cllr. H. Varney Sherman, Dr. Eugene Shannon , E.C.B. Jones and others in the Sable Mining corruption case prosecuted by the Special Presidential Task Force on Friday suffered another setback after they lost what prosecutors termed as a ‘frivolous motion’ before His Honor Yarmie Quiqui Gbeisay, Sr., Assigned Judge, First Judicial Circuit, Criminal Court “C”.

This brings to fore more than three motions that the Defense counsel have lost in the ongoing case involving the Grand Cape Mount County Senator and some former officials of government in the country.

Lawyers representing the above Co-defendants had earlier filed a ‘motion to strike’ the Prosecution’s motion to amend the original indictment, praying the court to deny the state’ motion to amend the indictment against their clients.

It can be recalled that the Defendants were charged for Bribery, Criminal Conspiracy, Criminal Facilitation, Criminal Solicitation and Economic Sabotage.

Among other things, Judge Gbeisay, Sr. in his ruling warned both parties against ‘unnecessary motions’ nothing that the ‘time is running out’ in the prosecution of the ongoing case.

He ruled that the Movant (Defense Lawyers) in their ‘motion to strike,’ failed to prove that the failure on the part of the Respondent (Prosecutors) to correctly caption the affidavit was ‘intentional’ and ‘intended to defeat the purpose of the pleading.’

Juge Gbeisay, Sr. therefore denied their motion and ordered for the said amendment to take effect.

“Wherefore and in view of the forgoing, the Movant’s motion to strike should be and same is hereby dismissed and denied. AND IT IS HEREBY SO ORDERED,” Judge Gbeisay ruled.
