The Greatest Conspiracy of All Times against Mother Ghana

A Supreme Court Judge, Mr. Justice Atuguda, appeared incensed on Thursday, when the hearing commenced at the Supreme Court on a petition challenging the election of President J.H. Mahama, filed by the opposition, NPP. He was the presiding judge over a nine-member panel to decide whether NDC should be joined in the case.

NDC in my opinion has nothing to do with the case, since the case is actually against the EC, namely the state and not against Mahama or a party. This is pure and simple a case of fraud. I repeat: this is a case of fraud.

Voter fraud and electoral fraud are suspected to have occurred and this lead to wrong results.

NDC has not been accused at all in this case. If voter fraud and electoral fraud are identified, then those directly responsible for preventing such a fraudulent practice should be punished and the election invalidated.

Now the sudden declaration of interest by NDC is to be considered by the nine-member team of judges presided by this Justice Atuguda, who has been rejected by Akuffo-Addos team because of suspected conflict of interest.

One columnist, a Ghanaian resident in Cambridge, U.K., writes the following:

“Conflict of Interest simply means in judicial terms a real or potential existence of a direct or indirect benefit. The conflict has to be known or should have to be known at the time of the case.”

I suspect highly that the Chief Justice is involved in this conspiracy to steal the election for NDC, because she knew who Justice Atuguda is, she knew about his family connections and yet appointed him to be the chairman of the nine-member commission.

Judge Atuguda's behaviour
is totally unacceptable. To pretend that he was being singled out by NPP people is in itself a disqualification of him, because he should have known that the action of NPP was not personal. To pretend that he was being victimised, is a shame.

I am a doctor of medicine and in medicine we do isolate people if we think that they are infectious and therefore risky to others. This isolation is not done because we have any concrete evidence that they could infect others but is done purely on the basis of preventive purposes.

What I find criminal about this judges' behaviour is that he was expected to have come out openly to announce his relationship to the Secretary of the President and on his own take the initiative to resign or at least offer his resignation. This he did not do.

In most European countries, especially in Germany, judges would recuse themselves from the case because of the risk of potential or real bias as well as the risk of an appeal to a higher court or even a judicial review.

The upshot of not declaring a conflict of interest is not only the possibility of damage to the image and credibility of the judge but the judiciary as a whole.

Justice William Atuguda's reaction
The least that can be said about this man is that he is a dishonest and a horrible human being. He has exposed his emotional instability usually found with people suffering from anxiety depression. He is, and I must say it loud, a nasty guy.

Because of these sorts of people, coming from the north of the country, a new organisation, called Ashanti Unite has been formed, with the sole aim of peacefully fighting for a federal constitution in Ghana.

This sort of threat, the kind of evil habit, being perpetuated in our country for the sole purpose of serving the interest of the people from the north at the expense of the other ethnic groups, especially the Akan, shall no more be tolerated. We cannot accept to be marginalised, while our resources are used to develop the Northern Region. If this is the reason why NDC and Mahama have connived to steal the votes of Ashantis, then Woe Betide them.

Ashantis cannot be made responsible for lack of opportunity for the Northerners for becoming Presidents of Ghana. The wish of any Northerner to be President of Ghana is a justified one. But this must be achieved not by rigging elections, but by reforming the present useless constitution of our country which helps only the Ewes. This constitution makes it easier for NDC to use fraudulent ways to win elections and makes it easier for a person like Babgin to prophesy that NDC is going to be in power for the next 20 years. What he forgets is, this year the constitution will not be reviewed but will be reformed.

Retrograde Amnesia
Those politicians in Ghana who do not suffer from retrograde amnesia and do not also suffer from dementia must be reminded of the following:

The NPP had nothing what so ever to do with the atrocious killing of three judges in Ghana.

The chairman of NDC pointed a finger at the National Executive Committee of NDC for claiming that 'if the Chief Justice Georgina Wood does not want to cleanse the Judiciary, then the NEC of NDC would'. They further stated that “there are different ways of killing a cat”.

Now, we have a judge from the north of Ghana, claiming that “this country is solid” under such treasonable threats but is breaking down if people pursue their rights through the due process of law. Does the brutal killing of three judges signify that “solid Ghana” ?

The NDC can turn and bend the law however they want they will still be the losers. I appeal therefore to all our Ashanti countrymen to peacefully ask for a referendum which leads to a federal constitution irrespective of whoever is declared the winner in these elections.

A Glimpse of Hope
In that my lovely country Ghana, there are two people who do stand out and deserve real praise. These are

1. Nana Konadu Agyeman Rawlings, for asking for true decentralisation and

2. Kwaku Baako, the Journalist from the Daily Guide, for constantly telling the truth.

God bless these two people.
Justice Atuguda said: “If we perceive the judiciary not to be independent, we will be gambling with the destiny of this country.”

Comments: This is a horrible statement. Horrible is the least that can be said about this man. I wish to quote a statement from Mahama, when he thought Rawlings was accusing NPP for corruption and was persistently asking President Mills to act. Mahama drew the attention of the ex-President Rawlings to what he described as due process of the law, and he was correct.

In Germany, “Rule of Law” is defined as rule, based on the law of the land.

I wish to draw the attention of this Justice Atuguda about the writings of James Harrington in 1556 with regard to what he described as “Supremacy of Just Law”.

You have a judge in Ghana who claims that fair trial is tantamount to destruction of the pillars of democracy. How is he going to believe that fraud or deception or any other crime for that matter is wrong ?

To conclude, I would like to say the following:
Justice Atuguda would do himself a lot of good if he would apologise to the people of Ghana and resign the position as a judge or resign as the chairman of the nine-member panel and save the image of the Ghanaian judiciary system and tell the whole world that he was wrong and ask God for forgiveness.
