The legal battle for Mfantseman West Parl. SeatPAINTSIL GOES FOR ASABEE`S JUGULAR
After firing a devastating election related suit at the fast track court within the week, Kweku Yamoah Paintsil, an alumnus of Akufo-Addo, Prempeh & Co graduate Institute for Accra's battleaxe lawyers, is now going for Hon Stephen Asamoah Boateng's jugular.
As an adjunct to his writ against the defendant (Asamoah Boateng), he has filed multiple reliefs demanding that not only is he seeking for Asabee's disqualification from standing election as the MP for Mfantseman West because he camped delegates and bribed them, he also insists that his conduct was at variance to the practice directive given by the New Patriotic Party, to guide all parliamentary candidates and should be punished.
Paintsil had already served notice that he had taped confessions of some of the delegates which he would seek to play in court.
In addition, Paintsil has gone for the head of the DCE, Mr. Quainoo Arthur, in his quest to purge the system by asking the court to take note of Arthur's conduct in engaging in partisan politics, including 'engaging in fraudulent electoral practices which in his view, offends the letter and spirit of the Local Government Act, 1993 (Act 462)- 'and the same has brought the office of Municipal Chief Executive into disrepute and opprobrium.
He added that the court should advise the President to remove him from office as Municipal Chief Executive for Mfantsiman
Municipal area on the ground that his conduct has brought the office into disrepute and contempt.
This is not the end of Asamoah Boateng's troubles, as Paintsil is also pushing for his disqualification from contesting or being elected a member of Parliament 'by reason of owing allegiance to the United Kingdom.'
In all there are 16 reliefs Kweku is seeking from the court; He is demanding that “an order restraining the 9th Defendant from in any way, whether by advertisement, campaign posters, participating in programmes, mounting political platforms, or howsoever, holding himself out as the 1st Defendant's (NPP) nominee or candidate for parliamentary elections in the Mfantsiman West Constituency until final determination of the suit or until the Court otherwise directs.
Still in battle-mood, Paintsil has indicated that he will not countenance any interference from any quarter in his suit and he is determined to see that the party which authored and subscribes to the book 'Stolen Verdict', to further NPP's belief in the sanctity of elections stay very much within the four corners of its beliefs.
Paintsil, who is also a radio pastor pressed for the following additional reliefs; Declaration that the purported election held on Monday 25th May, 2008, being a national public holiday, was a nullity as being in breach of the letter and spirit of the Public Holiday Act, 2001( Act 601).
Declaration that in the matters that have transpired, the 6th, 7th and 9th Defendants' conduct are in material breach of the 1st Defendant's 21-point code of conduct as well as the letter and spirit of the Representation of Peoples Law,1992 ( PNDC L. 284).
Declaration that the conduct of the said election was fundamentally flawed as to amount to a nullity.
Declaration that the 1st and 2nd Defendants' conduct in issuing a 21-point code of conduct and deliberately refusing to investigate and/or act on allegations of electoral malpractices and fraud is contrary to the letter and spirit of Article 55 (5) of the 1992 constitution, the Political Parties Act, 2000 ( Act 574) and Representation of Peoples Law,1992( PNDC L 264) ;
An Order annulling the results of the said election as void; An Order directed to the 1st defendant to conduct fresh election to elect a parliamentary candidate for the Mfantsiman West Constituency.
Finally, he is asking for general damages to boot. Asamoah Boateng is yet to file a response to the charges as Chronicle learnt he had travellled.
