The Ghana Bar Association (GBA) has waded into the ongoing process regarding petitions seeking the removal of the Chief Justice of the Republic, Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkornoo.
The GBA has urged that all persons involved in the process to discharge their duties in a manner that enhances the independence of the judiciary, in line with Article 296 of the 1992 Constitution.
In a statement dated April 24 and signed by its President and National Secretary, the GBA reiterated that justice emanates from the good people of Ghana and is administered by the Judiciary, which is headed by the Chief Justice.
“It is expected that persons who play even the minutest role in this process will bear in mind Article 296 of the 1992 Constitution on the exercise of discretion and will act in a manner that safeguards and enhances the independence and image of the Judiciary.
“Justice emanates from the good people of Ghana and is administered by the Judiciary headed by the Chief Justice,” the statement read in part.
This comes after the suspension of the Chief Justice, Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkornoo.
President Mahama, on Tuesday, suspended Chief Justice Torkornoo with immediate effect, citing a prima facie case established against her in three separate petitions.
The suspension, in accordance with Article 146(6) of the 1992 Constitution, was made in consultation with the Council of State.
A statement from the Presidency, signed by the Minister of State in charge of Government Communications, Felix Kwakye Ofosu, also announced the formation of a committee to inquire into the petitions.
