The Supreme Court has dismissed an application for an interim injunction seeking to stop the Amenfi Central Parliamentary election.
The plaintiffs, who have an ongoing case against the National Democratic Congress (NDC) and its candidate Joana Gyan Cudjoe at the Sekondi High Court, filed a certiorari application with the Supreme Court on Wednesday, December 4, 2024. Their goal was to overturn the High Court's earlier decision to vacate an injunction imposed on the NDC and the Electoral Commission (EC).
Justice Yonni Kulendi, acting as a sole judge, heard the ex parte application on Thursday, December 5, and dismissed it, effectively allowing the parliamentary election in Amenfi Central to proceed as scheduled.
This legal battle stems from a November 11, 2024, ruling by the Sekondi High Court, presided over by Justice George K. Gyan-Kontoh, which overturned an earlier injunction that had barred Joana Gyan Cudjoe from contesting the election. The High Court had sided with the NDC’s argument for dismissing the disqualification case against their candidate.
The initial injunction had been postponed after a request by Edudzie Tamakloe, one of the lead counsels representing Joana Gyan Cudjoe, paving the way for subsequent legal proceedings.
With the Supreme Court’s ruling, the election in Amenfi Central is set to proceed without further legal impediments.
