The Sekondi High Court has ruled in favor of Joana Gyan Cudjoe, the National Democratic Congress (NDC) parliamentary candidate for Amenfi Central, lifting an injunction that barred her from contesting in the December 7 elections.
This decision paves the way for Gyan Cudjoe to re-enter the race, which she describes as a victory for justice and a vindication for the innocent.
In a statement following the ruling on Monday, November 11, Gyan Cudjoe likened her experience to the biblical story of Job, highlighting how justice ultimately prevails despite hardships.
“Justice is not just a divine prerogative but also a human responsibility,” she remarked. “Though it comes slowly, it vindicates the innocent.”
Expressing gratitude for the outcome, she thanked her legal team, led by Thaddeus Sory, Israel Ackah, and Edudzi Tamekloe, whose efforts she credited for her reinstatement.
“Their expertise and dedication were instrumental in this significant victory,” she said.
Background:
Following the NDC’s May 13, 2023, parliamentary primaries in Amenfi Central, where Madam Gyan Cudjoe defeated incumbent MP Peter Yaw Kwakye-Ackah, a lawsuit was filed by some dissatisfied individuals, resulting in an interlocutory injunction that temporarily restrained her from acting as the duly elected candidate.
In response, the NDC’s Functional Executive Committee annulled the May 2023 election and conducted fresh primaries on September 8, 2024.
Gyan Cudjoe once again emerged victorious, with the Electoral Commission (EC) overseeing the process.
The NDC argued that the September election superseded the May contest, reinforcing Madam Gyan Cudjoe’s legitimacy as the party’s candidate.
However, the EC later disqualified her, citing the interlocutory injunction related to the annulled May election.
