Suspended Chairman of the opposition New Patriotic Party (NPP) has appealed the dismissal by a High Court of his suit that challenged the legality of his suspension by the party.

Paul Afoko said in an Appeals Court suit filed on Monday August 22, 2016 that the High Court Judge, Justice Anthony Yeboah, erred when he ruled on August 15 that the NPP’s National Executive Committee acted lawfully when it suspended him indefinitely.

“The learned trial Judge erred in referring and relying on evidence and documents on record that had earlier been expunged, in his judgment thereby occasioning a grave miscarriage of justice,” Mr Afoko said in his statement of claim to the Appeals Court.

The Accra High Court, Human Rights Division on August 15 dismissed Mr Afoko’s case challenging the legality of his suspension on October 2015.

The trial Judge, Justice Yeboah said the NPP’s National Executive Committee did nothing unlawful when it adopting recommendations of the Disciplinary Committee of the party to suspend the then National Chairman.

Paul Afoko filed the suit at the Accra High Court on December 7, 2015, citing the NPP and its Acting National Chairman Freddie Blay of unconstitutional and unlawful acts.

Mr Afoko insists that he was the duly elected Chairman of the NPP and that his suspension was illegal and contravened the opposition party's constitution.

Mr. Paul Afoko was suspended indefinitely by the party in October 2015 after the NPP’s Disciplinary Committee recommended his suspension following a petition filed by two members of the party.

The petitioners allege Mr Afoko has been working against progress of the party.
