Blows Over Robbery Trial
06.10.2015 LISTEN

Tempers flared in an Accra Circuit Court yesterday when a defence lawyer and the prosecution clashed over attempts to delay a robbery trial.

Seidu Nasigri, lawyer for one Sulley Fuseni who is being tried for robbery, did not take kindly to a request by the prosecutor, ACP Moses Atibillah, to adjourn the trial.

ACP Atibillah had asked for an adjournment to enable the prosecution start the trial but Mr Nasigri disagreed, insisting that the prosecution must start the case.

According to him, the prosecution's request was becoming their style if they (prosecution) wanted a conviction at all cost.

Mr Nasigri, with particular reference to an earlier case in which he had defended the accused person, stated that the facts did not support the charges preferred against the accused.

He therefore prayed the court to grant bail to Fuseni.

Incensed by the position of Mr Nasigri, ACP Atibillah drew the attention of the court to the words of the lawyer, insisting that he withdrew same.

Aboagye Tandoh, the presiding judge, urged both parties to exercise restraint and desist from being sentimental in the discharge of their duties.

He adjourned sitting until October 14, 2015.
Charged with conspiracy to rob and robbery, Fuseni denied the offence and was remanded into police custody.

Fuseni and two others currently at large are said to have on August 14 this year, at Nima in Accra, robbed one Hamsa Sanusi of his Nokia Asher 200 phone, Samsung Note 3 (both worth GH¢1,460) and a cash amount of GH¢ 350.

The facts are that Hamsa is a tailor while Fuseni is a businessman. On the aforementioned date, at about 12am, the complainant engaged Fuseni in a conversation at the Nima Roundabout.

According to ACP Atibillah, the accused and his accomplices accosted Hamsa, bundled him and took him to the Nima township where his dress was removed.

He said Fuseni and his accomplices laid Hamsa on a table and subjected him to severe beatings with belts and canes and robbed him of the aforestated items and cash.

The senior police officer said the accused persons then posted a video of all that happened on their Facebook wall claiming that the complainant was a homosexual. After that they went into hiding until Fuseni was arrested on September 15.
