Nigerian Car Dealer In Court Over Fraud

A Nigerian from Anambra State has been hauled before an Accra circuit court over a GH¢34,000 fraud.

The accused, Kingsley Onyebuchi Oyaka, is alleged to have collected the cash from one Johnson Ofori, a contractor.

According to the prosecution led by DSP Suleimana Adisa who represented ASP Stephen Adjei, the accused on July 31, 2014 collected the said amount from the complainant under the pretext of buying a Nissan Frontera vehicle for him.

Appearing in a court presided over by Afia Kumador, Kingsley rebutted the charge of defrauding by false pretences contrary to Section 131 of Act 29/60.

The trial judge however, granted the accused bail in the sum of GH¢70,000 with two sureties one to be justified.

Earlier, Ms. Kumador had issued a bench warrant for the arrest of Kingsley who failed to appear in court for the hearing.

The case has been adjourned until October 6, 2015.
The facts of the case are that on the said date, the complainant saw a Nissan Frontera vehicle at Kingsley's garage which he decided to buy and as such contacted the accused for the price.

DSP Adisa said the accused gave the cost of the vehicle as GH¢40,000 out of which Ofori paid GH¢34,000.

The prosecutor stated that Kingsley promised Ofori that he would release the vehicle to him if he paid part of the price, but the accused failed to honour his promise.

According to DSP Adisa, several attempts by Ofori to either get the vehicle or retrieve his money proved futile.

She said on March 16, 2015, the accused was arrested and in his caution statement, admitted having collected the said amount from the complainant.

The prosecutor further disclosed that Kingsley said he was unable to deliver the vehicle due to some difficulties and pleaded for two weeks to do so.

She said Kingsley was able to hand over only  GH¢5,000 to the police.
