The family of the late Emmanuel Osei has filed a suit at the high court against the Attorney-General and Minister of Justice in connection with the death of the former.

Also joined in suit are the Inspector General of Police and one General Constable Ibrahim Aminu, an officer of the Police Service.

The late Osei died on January 21, 2008 at the Komfo Anokye Teaching Hospital in Kumasi as a result of gunshot wounds he sustained from General Constable Aminu at the Zongo Police Station in Kumasi.

He had been posted there to do his national service with the Ghana Health Service when the incident occurred.

The statement of claim attached to the suit filed by Appiade Chambers in Accra, lawyers for the plaintiffs, said Osei died as a result of the negligence of General Constable Aminu.

It said the police officer had 'failed to exercise due care and diligence in handling firearms at a human populated area.'

The statement further posited that General Constable Aminu again failed to act with care and diligence as to avoid firing gunshots at the late Osei.

As a result, the family is demanding from the defendants jointly and severally the sum of GH¢ 20,191 as special damages with interest from due date until date of final payment at the prevailing bank rate.

The family also wants the court to order the defendants to pay general damages of GH¢50,000 for the pain and suffering of the deceased; GH¢100,000 for the loss of the expectation of life of the deceased and GH¢50,000 for the emotional stress suffered by Madam Afua Mensah, mother of the deceased, the 6-year- old daughter of Emmanuel Osei and others with interest from the date of award until date of final payment at the prevailing bank rate.
