Court Throws Out NDC Case

An Accra Fast Track High court yesterday dismissed an application by three members of the National Democratic Congress (NDC) in the Greater Accra region who are aspiring for various executive positions in the region.

They had wanted to restrain their party from holding its regional congress, which comes off this weekend.

The plaintiffs/applicants are Patience Boakye, King Etse and Setordjie Wilson – all from Kpong Katamanso who brought an action for interlocutory injunction on realizing that they had been given a raw deal by the regional executives when they were disqualified from contesting the regional executive positions.

Justice Habib Logoh, who dismissed the injunction, said the plaintiffs had not shown what specific injury they would suffer if the regional congress was held.

Even though they said their rights would be infringed if the congress went ahead, according to the judge, they had not shown what right of theirs would be infringed.

The trial judge consequently dismissed the application.

Patience was aspiring for the post of Regional Women's Organiser while the other two were hoping to be elected for various positions, including Regional Youth Organiser. The plaintiffs/applicants were represented by Godwin

Tamakloe while the defendants/ respondents were represented by A.W.Tamakloe.

An interim injunction was placed on the NDC a few days ago by an Accra High Court which has restrained the regional executive committees of the party from selling, receiving, endorsing nomination forms or doing anything required for the organization of elections in the party from the constituency to the regional level.

The court, presided over by Mrs. Justice Barbara Ward Acquah, later dismissed the injunction.

The writ was filed by Mr. Bossman Oduro-Fosu against the NDC 'for flouting paragraph 6 (c) of the party's constitution on the election of party executives.'
