Statement of facts on issues involving Telegenicca Ghana on some media houses
Telegenicca Ghana Limited is a wholly Ghanaian Company registered under the laws of the republic of Ghana with Ghanaians as the majority shareholders.
Telegenicca Ghana Limited is a Telecommunication outfit currently executing contracts for HUAWEI, under strict standards of the Industry Telegenicca Ghana Limited has currently on her payroll over Twenty Five (25) Ghanaian Engineers, and subcontract agreement with Five (5) Ghanaian companies namely;
LCG VENTURES DOLPHA CONSTRUCTION LIMITED AUSBERT CAMPANY LIMITED PETER ROY TECHNICAL LIMITED FONDA ENGINEERING & CONSTRUCTION LIMITED
Telegenicca Ghana Limited civil works implementation agreement include thirty days (30) completion for all civil construction and strict adherence to Health, Safety and Environmental (HSE) practices to reduce risks and liability to field workers and the general public. Telegenicca subcontract payment terms are as follow;
30% Mobilization 30% After casting of tower foun dation and backfill. 30% Upon completion and accep tance of all Civil works by Huawei. 10% Retention payable after 60 days.
Telegenicca Ghana Limited has not defaulted in any of the above contract terms to any of our subcontractors and this can be verified from our payment vouchers and bank statements.
Telegenicca Ghana Limited has a good working relationship with our entire subcontractor's except one that constantly defaults the contractual agreement and failing to adhere to strict the agreed schedules of works and non compliance to HSE regulations.
Telegenicca received several code violation warnings from Huawei at various times and was even made to pay a penalty for HSE violation due to the recalcitrant attitude of this subcontractor. (We have extracts of various correspondences as evidence)
Telegenicca also issued several verbal and written warnings to the defaulting subcontractor (We have extracts of various correspondences as evidence).
When it became obvious that there was no change in approach from the subcontractor, the Management of Telegenicca Ghana Limited was left with no other option than to terminate the contract in compliance with the contract terms purposefully, to protect our professional integrity and our commitment to HSE standards which is an issue of great concern to Huawei and Vodafone clearly stated in our subcontract agreement with Huawei.
Having paid the subcontractor up to 60% of the contract sum up to that stage (we have documented evidence), the management of Telegenicca instructed the subcontractor to carry out a joint evaluation of all works done with our site engineers for final determination of the contract.
After the letter of termination was issued, we received a report from our site engineers in Kumasi that the subcontractor had instructed some unidentified thugs to molest anyone who attempts to work at the site.
Like all law abiding citizens, the management of Telegenicca instructed our site Engineers to make an official complaint at Ridge Police station, Kumasi, to ensure the safety of life and property at the site. (Please see police records at the Ridge, Kumasi).
This we can confirm was the only time on record that Telegenicca, as an organization, has ever had any contact with the Ghana Police since we started operations.
Coincidentally, soon after the termination of the contract, an article appeared on Ghanaweb, seeking to destroy the image of Telegenicca with a deliberate intent on dragging the names of our esteem client Huawei and the principal client, Vodafone, in the mud by insinuating that all three organizations are cheats and fraudulent.
For the avoidance of doubt, we will like to state categorically that there was never a time that Huawei or Vodafone had ever been involved in the contractual relationships that exist between Telegenicca and her subcontractors.
Without doubt, the article hosted on Ghanaweb was put together by people with malicious intent and mischief with the sole aim to tarnish the good image of Telegenicca Ghana Limited.
For the records, we have never connived with any Ghanaian citizen, politician, government agency or local or foreign company, in particular VODAFONE GT, or HUAWEI to defraud any company.
Telegenicca Ghana Ltd. was awarded the contract with Huawei based on our expertise and experience in the telecommunication industry, and we went through strict due diligence with Huawei Technologies and emerged successful as the only indigenous company.
With the degree of damage that this article sort to achieve, we have instructed our Lawyers to take the necessary action in the Courts of Ghana to seek a just remedy against the publishers and administrators of Ghanaweb, and for a retraction and public apology for the libelous article published.
